00:09Madam President, I rise to make a motion.
00:12The Majority Leader has argued that Secretary Mayorkas' defiance of federal immigration law
00:17and active aiding and abetting of the worst criminal invasion in our nation's history
00:22does not constitute a high crime or misdemeanor.
00:26He has presented no argument on that question.
00:28He has presented no briefing on that question.
00:30And the position is directly contrary to the Constitution,
00:34to the original understanding of the Constitution at the time it was ratified,
00:38and to the explicit position of the Biden Department of Justice
00:42as argued before the Supreme Court of the United States.
00:46The Majority Leader's position is asking members of this Senate to vote on political expediency
00:53to avoid listening to arguments.
00:55The only rational way to resolve this question is actually to debate it,
00:59to consider the Constitution, and consider the law.
01:02The Senator will recognize that the Senate is in a non-debatable position.
01:07The Senator has a right to offer his point of order, or his motion,
01:12but we are in a non-debatable position.
01:14And my motion is to change that so that we can actually debate the law
01:18if Senators care what the Constitution and law says.
01:21I therefore move that the Senate proceed to close session
01:24to allow for deliberation on the question as required by Impeachment Rule 24.
