00:08 guilty to a charge of cheating and dishonesty linked to the procurement and management of
00:13 the government's vehicle fleet.
00:15 The 83-year-old claimed trial to the charge after it was read out before Kuala Lumpur
00:20 Sessions Court Judge Susana Husin on Wednesday.
00:24 Tan was accused of cheating and inducing the Finance Ministry through the Public-Private
00:29 Partnership Unit to award Spanko a contract worth over 3.96 billion ringgit.
00:35 He allegedly cheated the tender opening committee by claiming that there was at least 30 per
00:40 cent Bumiputra shareholding in Spanko in its document entitled "Appendix IV, Bidder's Profile
00:48 of the Request for Proposal for Supply, Repair, Maintenance and Management of Government of
00:53 Malaysia Vehicle Fleet".
00:55 The offence was allegedly committed at the Ministry's office in Putrajaya between February
01:00 27 and 28, 2019.
01:04 The charge was framed under Section 420 of the Penal Code and provides for a jail term
01:09 of not less than a year and not more than 10 years, caning and a fine upon conviction.
01:16 MACC DPP Mahadi Jumat offered 2 million ringgit bail with one surety, with the conditions
01:24 that the accused surrenders his passport and reports to the KLMACC office on the first
01:30 week of every month until the trial's conclusion.
01:33 He also proposed that the accused should not contact the witnesses during the trial.
01:38 Tan's lawyer Datuk Wan Azmir Wan Majid said in mitigation that, although his client agreed
01:44 to the bail amount, he was not a flight risk owing to his age and health.
01:49 He said his client is suffering from hypertension, knee and back aches, and requires medical
01:54 attention, adding that Tan relies on a cane and the help of his assistant to move around.
02:00 Judge Susana then fixed bail at 2 million ringgit with one surety, with the additional
02:06 conditions.
02:07 The case is set for mention on June 4.
