A section of members of the Daputo/Dafur settlement welfare scheme situated in Embakasi has moved to court seeking to have Kenya Railways Corporation barred from paying any compensation to anyone purporting to be acting on their behalf.

00:00 Sometime last year, the government gave them ownership of the land,
00:05 measuring it with the EBRAS.
00:08 And they entered into an agreement, as you see from my documents,
00:14 which we acquired EMC number 4 of 2024.
00:18 And a government entity, Kenya Railways, bought their land.
00:26 And money was paid. A lawyer who was me was removed from the deal.
00:34 And a new lawyer, whom they don't know, was brought in to get the money.
00:39 And that is where things happened.
00:42 Their money was stolen. It was a brazen stealing of these people's money.
00:49 And they lost, they got only just about 10%.
00:55 These people were 300 on the land. It's just a few of them.
00:59 And so the cartels which came there, including government officials,
01:04 including their own officials, because they had officials, took all the money.
01:11 And these people were displaced.
01:14 And now they are outside. They were not able to get enough money to settle.
01:20 And they have come back to seek justice.
01:25 This case demonstrates how their names were used to get money out of railways,
01:32 and then taken by other people other than the beneficiaries who got the money.
01:39 It's a very sad case indeed, that people use these poor Maasai names to get their money out of railways.
01:47 They took 2.7 billion, precisely, and they took all the money. Very sad.
01:53 So we have come to court, and we have come to seek justice.
01:58 We are saying that railways which were the land cannot take possession of the land
02:03 because they did not ensure the money went to these poor people.
02:06 You can see this lady holding a child. She is now displaced.
02:10 And all of them were very sad people.
02:14 So we have come to seek justice for them.
02:17 We have filed a case. We are waiting for directions from the court on how this matter.
02:22 But we are seeking injunctive orders to stop them from taking over the land.
02:27 And we are seeking also for those people to account for the money.
