Ipoh court acquits husband and wife of three drug charges

A husband and his wife have been acquitted and discharged of three drug charges by the High Court in Ipoh, Perak.

Justice Datuk Abdul Wahab Mohamed made the decision on Wednesday (Jan 17) after finding that the prosecution had failed to prove with reasonable doubt the allegations made against Yong Shin Haw, 48, and Felicia Diong Chew Li, 38.

00:07 Justice Datuk Abdul Wahab Mohamed made the ruling on Wednesday after finding that the
00:12 prosecution had failed to raise "reasonable doubt" to prove the charges against 48-year-old
00:17 Yong Shin Hao and 38-year-old Felicia Deong Choe Lee.
00:21 Both accused were jointly charged under Section 39B, Subsection 1, Subsection A and Section
00:27 12, Subsection 2 of the Dangerous Drugs Act.
00:31 In the first charge under Section 39B, Subsection 1, both accused were said to have distributed
00:37 more than 1,400 grams of methamphetamine at a house in Kampung Selamat, Setiawan on February
00:43 24, 2020 at about 3.40pm.
00:46 In the second charge under Section 12, Subsection 2, they were accused of possessing about 8.4
00:52 grams of heroin and 1.5 grams of monoacetylmorphines at the same location, date and time.
00:59 In the third charge under Section 12, Subsection 2, both were said to have in possession about
01:05 42.5 grams of ecstasy in front of the house in Kampung Selamat on the same date at about
01:11 3.30pm.
01:13 In his judgment, Abdul Wahab said the prosecution had failed to prove that the drugs had belonged
01:18 to the accused.
01:20 He said the existence of another person, a tenant who has access to the room on the second
01:25 floor of the accused's house where the drugs were found, showed that there was a possibility
01:29 that the drugs could have belonged to him instead of both accused.
01:34 The judge added that the accused's DNA and fingerprints were also not found on the drugs
01:39 or equipment used for taking the drugs.
01:42 Shortly after an interval, Yong was found guilty to a fourth charge under Section 12,
01:48 Subsection 2 of the Dangerous Drugs Act.
01:50 Yong, a contractor, was said to have possessed more than 11 grams of methamphetamine in front
01:56 of the house on February 24, 2020, at about 3.30pm.
02:02 Abdul Wahab said the accused failed to prove with reasonable doubt that the drugs, which
02:06 were found in a sling bag, were not his, and sentenced Yong to five years in jail starting
02:12 from the date of his arrest on February 24, 2020, and to be whipped three times.
02:18 When met after the proceedings, lawyer S. Selvam said Yong could return home after being
02:23 whipped and need not be jailed since he has already served his time in jail.
