00:00 Some doctors are asking for a judicial review on the case of Dr. Benigno Agbayani.
00:06 He passed away last October after being helped by Guilty in the case of a patient who was infected and passed away after surgery.

00:30 He was jailed in May after being convicted in the case of reckless imprudence resulting to serious physical injuries in the complaint of a patient.

01:06 The case was initiated by the patient's lawyer, Saul Jofelena Jr. who said that his illness was getting worse and he was infected after being operated by Dr. Agbayani in Tuhud in 2006.
01:19 In the statement given by Atty. Jofelena, he said that since he was operated on in January 2006, he had multiple operations due to infection.
01:30 He said he had a wheelchair for two years and went through three years of rehabilitation.
01:36 It's not a medical error, it's a complication that can happen in all operations that can cause infection.
01:46 Before he died, last month, Dr. Agbayani said that he wanted to review the case because he did nothing wrong.
01:55 That's why an online petition is now rolling for a judicial review of Dr. Agbayani's case.
02:01 There might be people who will take advantage of this and say that you can demand Dr. XYC if something like that happened.

02:13 But Law Professor Atty. Michael Chu of UP College of Law said that doctors should not be afraid.

02:25 The decision was made by the doctor's lawyer who did not follow the deadlines set by the court to appeal and submit the documents to prove that the doctor should not be jailed.
