00:00 A college student is crying after experiencing a shock.
00:04 A conductor of a modern jeep passed out after being hit by a double
00:08 during his massage because of the impact on his body.
00:11 Is that how it is?
00:13 Plus size?
00:14 What does the law say about these situations?
00:18 Let's talk to Atty. Gabby Concepcion.
00:22 Good morning to you too, Ivan.
00:24 This student is pitiful.
00:27 I'm sure there are many people who relate to this situation, especially to jeeps.
00:31 Since there is no division in the seats,
00:33 can a passenger stop a double if the seat is big enough for public transport?
00:39 Well, I don't think so.
00:41 I don't think it's right.
00:43 I don't know of any law or regulation that allows this kind of behavior
00:49 in jeeps and buses.
00:51 In fact, it should be considered a form of discrimination
00:55 and the jeepney operator may be penalized for overcharging
00:59 under the Joint Administrative Order 2014-01 of the LTFRB and LTO.
01:06 If you are charged double,
01:08 that's an extra Php 11,
01:10 you may be fined for overcharging Php 5,000 for the first offense,
01:16 Php 10,000 for the second offense,
01:18 and Php 15,000 for the third offense.
01:20 And maybe you may be cancelled by the police at the end.
01:24 What if the way of asking is a bit offensive?
01:28 And the passenger is being chased and embarrassed?
01:31 If it's just a bit offensive, it's hard to predict.
01:35 Maybe there's no personal case that this passenger can file
01:39 against the driver that the treatment is a bit offensive.
01:43 If this is the case, he should complain to the operator or to the LTFRB
01:48 because other than overcharging under the rules of the LTFRB,
01:52 there's also a liability if the personnel of the public utility jeep
01:57 is offensive, discourteous, or arrogant.
02:00 If it's too offensive, depending on the situation,
02:03 there may be cases of unjust vexation or if the reputation is damaged
02:09 and this is in the use of foul language, maybe even oral defamation.
02:15 But if this is too offensive because this is sexual in nature,
02:20 there are more possible cases because it's prohibited to be rude
02:25 to the public in our vehicle.
02:27 Under the Republic Act 11313 or the Safe Spaces Act,
02:31 gender-based sexual harassment is prohibited,
02:34 including unwanted comments or sexual remarks, or the look that is offensive.
02:39 Under the LTFRB Memo Circular 2023016,
02:44 the operator, driver, conductor, or employee
02:47 may be fined and suspended for 6 months if they commit any act of sexual harassment.
02:54 The second offense is 10,000 pesos fine, vehicle suspension for 1 year.
02:59 For 1 year.
03:00 And the third offense is a fine and revocation of the Certificate of Public Convenience.
03:06 So the operator will not take the right action
03:09 if someone complains about this behavior of the passenger to their driver.
03:14 This will be a lesson for us all.
03:17 You mentioned, Tony, unwanted comments.
03:19 So let's not comment on the body as a general rule.
03:23 We need to remove it because everyone thinks it's okay.
03:26 Maybe it's cultural in our culture sometimes.
03:30 But unwanted comments are not appropriate in our time now.
03:36 Tony Gabby, thank you very much.
03:38 Thank you very much.
03:39 Have a great week.
03:40 Keep safe.
