In this video, I will discuss whether a widow and her minor daughter is entitled to reside in her matrimonial home and is she entitled to claim maintenance from her brother-in-law. In the case in hand, two brothers along with their family were residing at Ancestral Hindu Joint Family Property and were carrying out a Joint Hindu Family Business. After the death of one of the brothers, the other removed his widow and minor daughter. In order to claim her rights in Family Business and property, she fought a legal battle from JMFC Court up till the Hon'ble Supreme Court.
I will also try to explain in brief the Sections which have been referred in this case by the Hon'ble Supreme Court i.e. Sec. 12, 2(q), 2(f) and 2(s) of DV Act and will summarize the arguments put forward by both the advocates and the considerations made by the Hon’ble Court.
