Flight Attendant’s Facebook Activity Examined in Wrongful Termination Suit

An Air New Zealand flight attendant who was fired for alleged misuse of sick leave will have to provide her Facebook and banking information before her reinstatement request will be considered.

Gina Kensington, an Air New Zealand flight attendant who was fired for alleged misuse of sick leave, will have to provide her Facebook and banking information before her reinstatement request will be considered.

In March, Ms. Kensington took two days of leave from her job to care for her sick sister.

When she returned to work, Air New Zealand fired her saying that she wasn’t truthful about her reason for taking time off.

Following the incident, she approached the country’s Employment Relations Authority, also simply called the ERA, about getting her job back.

Air New Zealand said that before they would consider her request, they wanted access to her Facebook and banking accounts so they could confirm her story.

She refused, citing that in addition to being personal, the information contained in either of those sources wasn’t involved in their termination decision.

The ERA recently decided that Kensington must comply for the matter to proceed.
