Judge invalidates New York City large soda ban

One day before a New York City ban on large sugary drinks was to go into effect, a judge says not so fast.

A State Supreme Court justice invalidated the ban Monday, calling it arbitrary, because it applied to some and not ALL food establishments.

The ruling was a blow to Mayor Michael Bloomberg.

He had pushed hard for the ban -- to combat what he said is an obesity epidemic in his city.

NYC MAYOR MICHAEL BLOOMBERG, SAYING:

"We were very confident this morning. We think the judge is totally in error in the way he interpreted the law and we're very confident that we will win on appeal."

Beverage manufacturers had complained the ban was an illegal overreach that infringes on consumer rights.

The city plans to appeal the ruling.
