00:20I want to say thank you to everyone that has helped us, that has supported us in fighting
00:28this and we will continue fighting for Kilmar, for my husband.

00:46to have my husband back.
00:58Judge Dennis granted the preliminary injunction and ordered that Kilmar Albrego Garcia be
01:03brought back to the United States by 1159 p.m. on Monday.
01:09She found that the government did not dispute that there was no legal basis whatsoever for
01:15his deportation.
01:17She found that the government's arguments that she was powerless to order him brought
01:22back to the United States were without legal merit.
01:25And she found that he was suffering irreparable harm with every day that goes by while he
01:30separated from his family and while he's detained under such harsh conditions in the infamous
01:35Seacott prison.
01:37I mean they've had well more than 24 hours.
01:40We filed this case on Monday of last week.
01:47The government has, right, so at this point I have every hope that they will not choose
01:54the route of appeal.
01:56Plenty of tweets, plenty of White House press conferences, but no actual steps with the
02:02government of El Salvador to take it right, no actual steps to bring him back and no actual
02:07steps to even communicate or provide documents to the lawyer who they sent into court to
02:11defend their actions.
02:13And so the judge found that the record was sufficiently clear that there is an agreement
02:17with the government of El Salvador and that pursuant to that agreement, Mr. Obrego-Garcia
02:25is being detained.
02:26He's not being detained based on any Salvadoran legal process, but rather he's being detained
02:32because the United States government has requested that he be detained.
02:37And so for that reason, she found that the defendants do have the ability to bring him
02:41back to the United States.
02:43And she ordered it.
02:44They should simply obey the judge's order, bring him back to the United States by Monday.

02:55The government conceded that this case has nothing to do with the Alien Enemies Act.
03:00And the government also conceded that Title 8 did not authorize the removal of him.
03:04Essentially, they agreed from the outset that there was no legal basis to remove him.

03:12this type of mistake is not going to happen again.
