00:00Under different conditions, the International Criminal Court will base the request for an interim release of former President Rodrigo Duterte
00:08who is facing a case of Crimes Against Humanity.
00:11Duterte's continued questioning of the way in which the former president was arrested has been dismissed from the court.
00:18That and other discussions were discussed in the exclusive interview of GEMA Integrated News in the ICC.
00:25In the first news, live with us, Maris Umali from The Hague, Netherlands. Maris.
00:35It's already past midnight here in The Hague, Netherlands.
00:39And even if we leave the Rome Statue, the International Criminal Court still has jurisdiction over the crimes that happened in our country
00:48when we were still in the ICC.
00:56Experts have different opinions on whether the former President Rodrigo Duterte should be transferred to the International Criminal Court
01:05for the case of Crimes Against Humanity that he is facing here.
01:09In my exclusive interview with the International Criminal Court, ICC Spokesperson Dr. Fadi L. Abdala gave me that they have jurisdiction over the crimes that happened when we were still a member of the ICC.
01:22So, the court's jurisprudence has already indicated that the ICC retains jurisdiction even after the withdrawal of a state,
01:33but only for the crimes that were committed during the period when the state was a state party to the ICC Rome Statute.
01:41A withdrawal does not affect these obligations and this jurisdiction of the ICC. It only affects the future.
01:51If there is a question on the method of arresting, the defense can sue the court.
02:00I can simply say, if there is any challenge to the lawfulness and legality of the arrest, it can be submitted to the judges and then judges will decide on that.
02:11Every suspect can petition the ICC for an interim release, but there are conditions that must be met in order for this to happen on behalf of the court.
02:25As a matter of general principle, all these conditions and questions need to be discussed before the judges.
02:34The technical measures and conditions have to be decided on a case-by-case basis by the judges and have to be accepted by a certain state for it to be ordered by the judges.
02:47It has happened in the past that an interim release has been issued, but this depends on the situation and the courts.
02:55The ICC in the Philippines is thankful because it proved that the international accountability mechanism in the country is failing when it responded to the diffusion request of the ICC.
03:08We understand that you want to remain focused in your work, but even the spamming of the ICC judges' pages does not alarm you at all.
03:17We are all focused on only one thing, which is delivering justice in the best conditions for the victims and to ensure that truth is revealed.
03:28As we mentioned, there are instances where an interim release has been issued, but it does not mean that if you were given an interim release, it is possible that you will not be charged.
03:43As we mentioned, there are instances where an interim release has been issued, but it does not mean that if you were given an interim release, it is possible that you will not be charged.
03:59This still depends on the evidence provided by the prosecution, defense, and the courts that will judge the alleged case.
04:12Thank you very much.
04:42.
