00:33Associate Justice Ami Lazaro Javier commented on the issue.
00:37Has PhilHealth paid all the recorded and recognized claims?

00:44Before it transferred the funds to the Treasury?
00:50Your Honor, in a certain cut-off date, Your Honor, definitely not all were paid.
00:59Not all were paid and yet you transferred the funds already.
01:04In the 2021 financial statement of PhilHealth, which was audited,
01:09PhilHealth paid Php1.16 trillion in benefits while its assets are only Php347 billion.
01:17This means that PhilHealth's deficit is more than Php816 billion.
01:23According to the adverse opinion of COA, PhilHealth did not follow the correct accounting standard and their deficit is likely to be even bigger.
01:32Financial statements do not present fairly the financial position of PhilHealth.
01:39In short, the negative equity of PhilHealth may be way more than Php816 billion.
01:47Even if you double up your assets, they're not enough to pay off your liabilities.
01:53The deficit gradually dropped to Php26 billion in 2022 but it's still a deficit.
02:00From these assets, the law requires PhilHealth to set aside a portion called reserve funds
02:11precisely to cover payments for the claims of beneficiaries and that portion has to be used exclusively for the claims, to pay the claims of the beneficiaries.
02:30And if there is an excess, then additional programs should be set up.
02:36And if there is still an excess in the excess, then investment may be made.
02:44But PhilHealth said that it will not pay all the debts at the same time.
02:48It can afford to collect the direct contribution of the members.

03:13The government corporate council of PhilHealth also said that PhilHealth will not be bankrupt because this is the government's answer.

03:26the government of the Philippines guarantees the financial viability of the program or the national health program administered by PhilHealth.
03:38Outside the Supreme Court, the petitioners asked why they are asking the government to return the 60 billion pesos they got from PhilHealth.
03:47The fund is not enough, they even returned it.
03:51The government abandoned its responsibility to give subsidies to indirect contributors, to the indigent.
04:02And now, it is being transferred to the contributions of the workers.
04:07It is clear that PhilHealth's fund is not enough for this reserve fund.
04:13It is not enough that we can say that as long as PhilHealth has a balancing fund, this is an excess fund.
04:19Dr. Tony Leachon also filed a petition against the government and Congress for giving zero budget to PhilHealth for 2025.
04:28The oral argument is still ongoing in the Supreme Court.
