00:00Senate President Francis Chiz Escudero made it clear that there will be no impeachment trial while the Congress is on break.
00:08Details on the national news of Daniel Manalistas of PTV.
00:14Can we say that there will be no impeachment trial during the break or is it difficult?
00:20Nothing. Legally, it cannot be that.
00:22It is clear now that there will be no impeachment trial while the Senate session is on break.
00:27Senate President Francis Escudero said that there is a need for a session to convene the impeachment court.
00:33However, the Senate session is adjourned and will return on June 2.
00:37For the impeachment court to convene, the Senate needs to have a session.
00:42For the impeachment judges to pass, the Senate needs to have a session.
00:48Although the trial can proceed even if it is recessed,
00:53just like what happened to the former Chief Justice Corona,
00:57it should be able to start, convene, and pass on to the judges when there is a session.
01:04So if there is an action, it will happen on June 2 when the Senate is resumed.
01:13We cannot rush it, but we also cannot ignore it for no reason or reasonable reason.
01:22Escudero insisted that there can be a special session,
01:25but he said that it is for the important bills that need to be passed.
01:30But Escudero asked if it is still possible for the impeachment to proceed.
01:34It is possible, but that is a subject matter to be decided upon by the President.
01:38Escudero insisted that he will not allow them to say that the impeachment has already been acted on
01:43and that it has already been passed.
01:45I don't think it will be right for them to sit here for a few months
01:51and forcefully say that whoever came to the Chamber,
01:56that you should hurry and act.
01:59No, it's not like that and I will not allow that.
02:04Escudero understood that it doesn't matter if it is in favor or against the impeachment,
02:08but he insisted that the Senate should be the judge in the impeachment.
02:11It is a judgment that does not require any justification.
02:14We will perform our duty and function with the whole neutrality of an impartial judge.
02:19And without fear nor favor, we will rule over things as we see fit
02:25and based on what is right and what the law provides.
02:28It is a big question now if this will pass in the next Congress or in the 20th Congress.
02:32Because if it passes, the term of some senators in June will be over
02:36and the impeachment proceedings will start on June 2.
02:40That is my belief.
02:42Why?
02:43This is an impeachment court,
02:46separate from the function of the legislature.
02:48What can we discuss here?
02:51The collegial courts.
02:53What are the collegial courts?
02:55The Sandigan Bayan,
02:57Court of Appeals,
02:58Supreme Court,
03:00the Constitutional Commission,
03:02the Civil Service,
03:04the Comelec.
03:05The question is,
03:07if we have filed a case against these people
03:10and the Supreme Court magistrates have changed their cases,
03:16the magistrates of the Sandigan Bayan Court of Appeals,
03:19because these are courts of record,
03:22will the case be dismissed if it continues?
03:26Isn't the answer that it will continue?
03:29According to Escudero, Vice President Sara Duterte, as a lawyer,
03:33he can stand as a lawyer for himself.
03:36VP Sara also has the right to confront the witnesses
03:39against him in the impeachment trial.
03:42Or stand as a witness.
03:44Sit down as a witness.
03:46That's okay.
03:47It's up to you.
03:48But he cannot forcefully testify in the case
03:53because it will violate, on the other hand,
03:54the right against self-incrimination.
03:57So he cannot call for a prosecution
03:59and force him to ask if he doesn't want to.
04:02From PTV Manila,
04:04Daniel Manalastas, Balitang Pambansa.
