00:00Supreme Court gave a judgment in 2014
00:04which is NALSA v. Union of India
00:06This is a very landmark judgment
00:08because Supreme Court saw the pain of transgenders in this judgment
00:12and issued an order for equal reservations for transgenders.
00:16This judgment has not been followed in many states.
00:20Rajasthan is one of them.
00:22In Rajasthan, the government issued a circular on 12th January, 2023
00:28in which all the transgenders in Rajasthan were put in OBC.
00:34Ganga Kumari, who is a petitioner and a transgender, challenged this matter.
00:40For this challenge, Division Bench 1,
00:44which is presided by Honorable Chief Justice and Honorable Nupur Bhatti Ma'am,
00:49after hearing this matter, issued a notice and admitted this matter.
00:54The state government has been given time to file a reply.
00:59Even today, transgenders are suffering so much
01:03and despite Supreme Court's judgment, they are not getting equal reservations.
01:09The primary reason for this circular challenge is
01:12that transgenders have been given vertical reservation
01:16whereas Supreme Court has said that they should get equal reservation based on their gender.
01:23Because of this, transgenders should get horizontal reservation.
