00:00It's been a long time since we debated the law on divorce in the country, and now it's being discussed.
00:07Let's hear the opinions of our fellow countrymen. Let's watch this.
00:14Last year, the House of Representatives passed the third and final reading of a bill that is far from bringing back the absolute divorce in the country.
00:24It recorded 131 votes in favor, 109 votes against, and 20 abstained.
00:31That's why House Bill 9349, also known as the Proposed Absolute Divorce Act, was passed.
00:37Now, let's hear the opinions of some of our fellow countrymen about the possibility of absolute divorce.
00:46For me, I'm not in favor. We have children who are pitiful, who have to be left behind by their families.
00:54Divorce in the U.S. is something that we are used to in developed countries.
01:02But aside from that, a husband and wife should not separate if they have committed to be together for the rest of their lives.
01:15In my opinion, if a husband and wife don't get along, then divorce should be allowed.
01:23If they live together in the same house, but the children don't get along, then they will continue to grow up.
01:30And of course, this is a domino effect. We will never know what the next situation will be when they grow up, when they go through those traumas.
01:38I'm not in favor of divorce, because the country will be more chaotic if there's a divorce.
01:44Although there are some who want a divorce, but for me, I don't want a divorce, because it affects the children.
01:52Despite the controversies and judgments, they continue to discuss how the public will accept this in the coming time.
02:04And now, we will be joined this morning by the Director General of the National Council,
02:09for Solo Parents, Mr. Reddy Guzman, to discuss their position on the adoption of the Absolute Divorce Bill.
02:16Good morning and welcome to Rise and Shine, Philippines, Sir Red.
02:19Welcome back, sir.
02:20Hello, good morning and thank you for inviting us.
02:24Sir Red, what is your position of the National Council for Solo Parents on the adoption of the Absolute Divorce Bill in the House of Representatives?
02:35Well, we welcome the passage of the divorce bill.
02:38Actually, this is not the first time.
02:41In 2018, if I'm not mistaken, the House of Representatives passed it, but it fell asleep in the Senate.
02:48So now, we're hopeful that our Senators would at least be able to adapt to the changes of our times.
03:01Sir, if this divorce bill is passed and it becomes the Absolute Divorce Law,
03:06will it help to have legal, good legal, and emotional support for our Solo Parents?
03:13Yes, definitely.
03:14Because as of now, we can see that the highest incidence, aside from the death of the spouse,
03:21one of the highest is the abandonment and the de facto separation.
03:27So in these instances, there is no legal procedure, no specified support, they just separated.
03:38So now, if you have a divorce bill that your spouse is going through,
03:42it will give importance on what kind of support should be given to the child when you separated,
03:49what is the responsibility of each one.
03:52So, it's not just that you woke up and you don't have a spouse anymore,
03:56that's not what's going to happen.
03:58Of course, if it's a Solo Parent, they still need financial support from their father or mother.
04:07I have a question, sir.
04:09When it comes to the Custodial and Visitation Rights, once they become Solo Parents,
04:14how will this Absolute Divorce Act affect the Custodial and Visitation Rights?
04:22As far as the Custodial is concerned, we have a family code that specifies 7 years old and below,
04:29it's up to the mother, unless we can prove that it's an unfit parent or unfit mother.
04:34This is one of the things that can be resolved, the Visitation.
04:38Sometimes, what happens is, when the separation of the spouse is so traumatic,
04:44the child is hidden.
04:46In fact, we have a Solo Parent, he has two children,
04:50he was forced to separate the child so that he won't be chased,
04:55so that he can escape from his wife who is already in a toxic relationship.
05:00So, the child was forced to be left with the father,
05:03he was forced to be left with the younger one,
05:05just to have the peace of mind and security that he won't reach his children,
05:11no matter how toxic their relationship is.
05:15So now, if you have a divorce bill, divorce law,
05:18these scenarios, our law, our judicial system will say,
05:26how about the Visitation?
05:28Does it have rights?
05:31It's hidden, right?
05:33What happens is, like in Nueva Ecija, there was an incident there,
05:39while the child was in school, the father went there,
05:42then the principal talked to him,
05:44and he took his child home.
05:48When the grandmother, the guardian, was following him,
05:50the child was gone.
05:52So, those instances will be reduced and avoided if we have a divorce law.
05:56Sir, you mentioned earlier that this bill has good legal and emotional support.
06:00Sir, how can we reduce the social stigma against solo parents?
06:05That's a good question.
06:07Because normally, when it comes to solo parents,
06:09there are implications that are really bad.
06:12Sometimes, even in the workplace, they say that it's easy to get a solo parent.
06:17So, if you have a divorce law now,
06:21it gives a person a fresh start.
06:25Because we have a legal separation,
06:28it does not dissolve the marriage.
06:30We have an annulment.
06:32But it should be based on the premise that the marriage from the very start is invalid.
06:38So, there's no middle ground here.
06:42If you suddenly changed your wife's behavior,
06:48you don't know that you entered into a toxic or violent relationship,
06:55there should be an exit always for our countrymen.
06:59Because marriage is not based on the paper.
07:03It should be based on the emotions.
07:05It should be founded on love.
07:07So, even if it's a hundred pieces of paper,
07:11if there's no love in the marriage,
07:13we should not feel that there's sanctity.
07:18So, this divorce law gives the right,
07:22gives the remedy for our solo parents and other countrymen
07:27who are looking for an exit in their relationships.
07:30Well, you're right, Sir Ed.
07:32This social stigma when it comes to solo parents,
07:35even us, we've experienced it,
07:37especially in Catholic schools,
07:39where parents are not allowed to enter if there's no marriage certificate.
07:44So, aside from the divorce bill,
07:48let's talk about the National Council for Solo Parents.
07:52How is the state of this right now?
07:54Well, right now,
07:56that's one of our focus,
07:58because he mentioned the social and emotional stigma.
08:03And we are working with the Department of Social Welfare and Development,
08:07we are their NGO partner,
08:09in their solo program.
08:11Because this is the program of the DSWD,
08:15where it addresses the psychosocial, emotional, mental well-being
08:20of our solo parents and their children.
08:22And this is a welcome development
08:25that the DSWD is not only financial,
08:28they will also provide psychosocial and emotional,
08:32which is one of the needs of solo parents and their children.
08:38Okay, for solo parents who want to know their rights,
08:42or their benefits,
