01:48During this session, the Minister of Justice, Abdel Latif Wahbi, in his capacity as a member of the instance in charge of the revision of the family code, presented before His Majesty the King Mohammed VI an exhibition on the process and the methodology of the work of the instance.
02:03The Minister of Justice and Islamic Affairs, Ahmad Tawfiq, in his capacity as a member of the Supreme Council of Ulema, presented the conclusions of the advice of the Council which established the essential legal foundation of certain proposals of the instance and took into account the main interest, the interest to find solutions in accordance with Sharia concerning other proposals.
02:29In this context, His Majesty the King Mohammed VI called on the Supreme Council of Ulema to pursue the reflection and to adopt constructive efforts on the issue of the family through the creation of an appropriate framework within its structure in order to deepen research on the problems of Fiqh related to the evolutions that the Moroccan family knows and which requires innovative answers in line with the requirements of the institution.

10:12We are very happy, it is thanks to the wisdom of His Majesty that we will, as usual,
10:18as in 2004, and now after 20 years, because in 2004 we voted for the Family Code,
10:25now in 2024 we really wish, before the release of 2024,
10:31to have things that will improve the situation of the family and of the woman, of course.
10:38So it is this royal wisdom that contributed from the beginning to have a commission that participated,
10:44that organized meetings, meetings and meetings with associations of all kinds,
10:51with political parties, with unions, with constitutional bodies.
10:56And then they brought back all the fruit of the work, the proposals to His Majesty.
11:02Then there was the Council of the Ulama.

11:33And my question is precisely, what do you think is the importance of the constructive Ijtihad
11:38in this review process?
11:41And how can it help to reconcile tradition and modernity in the reforms of the Family Code?
11:49Well, for the Ijtihad, in the letter of His Majesty,
11:54which was really, really relevant to Mr. Arnouj,
11:57in order to do the work to build the commission that will work on the revision of the Family Code,
12:06it was really very important.
12:08We are in an Islamic country where we respect Islam, we respect our customs,
12:14but at the same time, the Ijtihad must be seen.
12:17We have received, we have had a lot of changes in Morocco,
12:21especially the family, especially the women.
12:24So all this, it calls us, that everyone must be there.
12:30It is the country that will win with a Family Code that will respect the family
12:36and the change that we have had during these 20 years,
12:39because we cannot deny all this change.
12:42I believe that with the scholars, it is very interesting,
12:46the fact that His Majesty wanted to intervene,
12:49the scholars, it's just because sometimes there are people who say,
12:54who talk about the Koran, who talk about things.
12:57So we would like someone who is in the field, who understands a lot.
13:01I don't understand things in Islam better than the scholars.
13:05So we want the Council to respect the choices of the Moroccans
13:10and the change that we want.
13:13So what we want and what we expect with great patience,
13:17this Family Code that will be for the next 20 years or 18 years,
13:21so maybe we'll talk about that in 2040, in 2044, I don't know.
13:26So it is mandatory that there will be a change that takes into account
13:31the changes that we have experienced during these 20 years,
13:34and we must have a view for the next 20 years,
13:37and the change that we have had,
13:39because I don't believe that there are significant changes that must be there.
13:44For example, I don't believe that there is someone who will vote for the minor marriage,
13:49while we insist that our children have the right to go to school until the age of 18,
13:56for the sharing of goods, because there are rumors.

14:03there are rumors in the streets.
14:05There are people who want to say that they want to destroy the family.
14:10This Family Code is not for the family, it is for the woman.

14:25The winner is Morocco.
14:27And the winners are the citizens.

14:33How do we respond to those who say that gender equality in the Family Code

14:45Well, I know that we have customs, there are things.
14:50It is certain that we must take into account the Moroccan specificity,
14:57but at the same time, we must all think positively and seriously
15:07that without a Family Code that will be fair, global and just,
15:18we will not improve things.
15:22Excuse me, what do you think are the priority changes that should be included in this revision?
15:33Well, we did talk about minor marriages each time, Article 20 and 21,
15:38because it was just, as we said, it became a rule.
15:45Marriage became normal.
15:49In 2004, there was a very, very important and relevant discussion about minor marriages.
15:56It was in specific cases, 17.9 months and all,
16:01and then we find marriages of children.
16:05We can't say girls, but children.
16:08Because we vote here in Morocco at the age of 18,
16:11so we have to respect the age of 18.

17:12So for you, the priority is first of all the marriage of the minors,
17:16the sharing of goods, and also guaranteeing a real equality between men and women.
