00:00Fireball Cinnamon Whiskey's maker is being sued for fraud because it's Fireball Cinnamon product
00:04isn't actually whiskey. Unlike Fireball Cinnamon Whiskey, Fireball Cinnamon bottles contain cinnamon
00:08and whiskey flavored malt beverage, not whiskey. Malt beverages include hard seltzers and wine
00:13coolers and are often flavored to give them different tastes. Malt beverages can also be
00:17sold in grocery stores and gas stations that carry beer and wine but aren't allowed to sell spirits.
00:22The Fireball Cinnamon Whiskey spirit is packaged similarly to the Fireball Cinnamon Malt beverage,
00:28which the complaint calls misleading. The lawsuit says bottle packaging describing
00:32Fireball Cinnamon as a malt beverage with natural whiskey and other flavors is a clever turn of the
00:37phrase that may lead consumers to believe the product contains natural whiskey, not natural
00:42whiskey flavoring. The complaint also alleges that the product's 99 cent price tag for a 1.7 ounce
00:48bottle of a malt beverage is overpriced. The Chicago woman suing the company in a U.S.
00:53district court is asking for over five million dollars for the misrepresentation of its product.
