00:00Faisal Chaudhary is with us in the Islambad studio.
00:04Thank you Faisal.
00:05Let's start with you.
00:06The 27th amendment is coming.
00:07There are a lot of issues in it.
00:09What are the big problems after the 26th amendment,
00:12which should be addressed?
00:14The government is saying that they will bring more clarity on this issue.
00:17The 26th amendment is a problem in itself.
00:21The problem with it is that the legislation,
00:24if it is a constitutional legislation,
00:27the aim is to reduce the issues that arise from it.
00:31With the 26th amendment,
00:33especially in our judiciary,
00:36the issues that have already been mentioned,
00:39like pending litigation,
00:42or appointment or other things,
00:45there will be more complications.
00:48The problem is that
00:51when there is a constitutional legislation,
00:54there is a broader consensus on it.
00:57Debates have to be held
00:59so that the nitty-gritties are removed.
01:02The problem is that the government
01:05sees that there is nothing in their own opinion.
01:08The order that comes from somewhere is so strict
01:12that the parliament is opened at night,
01:16debates are not held,
01:18and the opposition is broken.
01:21And then the marriages are told that
01:24we have done this,
01:27however we have done it,
01:30we are happy with it,
01:33despite being ashamed of it.
01:36This is called the Imran agreement in Urdu.
01:39The basic law of the agreement is that
01:42the agreement cannot be by force.
01:45The amendment has been brought by force.
01:48And the parliamentarians and senators
01:51who are present there,
01:54if they are rejected in such a way,
01:57like kidnapping someone,
02:00kidnapping someone's family,
02:03kidnapping someone's children,
02:06it is considered normal,
02:09which is not the case in civilized countries.
02:12That is why the amendment was brought
02:15in the 26th, 27th, and 47th.
02:18If there is no consensus...
02:21What do you mean by consensus?
02:24Your Chief Minister was present
02:27at the hearing.
02:30What do you think?
02:33Do you think that the Chief Minister,
02:36K.P.Ali Ameen, will bring a tank?
02:39He has given a point of view.
02:42His party has also given a point of view.
02:45Mr. Khan has also given a point of view.
02:48In the 26th, he was attacked
02:51on the freedom of the judiciary
02:54and on the rights of the people.
02:57If he does not come to the Oath Ceremony
03:00of the Chief Justice of Pakistan,
03:03then you will say that he did not come
03:06to the Oath Ceremony of the Chief Justice of Pakistan.
03:09I think that Mr. Ali Ameen has brought
03:12a good amendment to the PTM protest.
03:15You have a technical objection
03:18but you have a bigger objection
03:21about the way it was brought.
03:24Let me just phrase one sentence.
03:27The issue is that it is a flawed amendment
03:30that has been brought in a corrupt way.
03:33This flawed amendment has a weight
03:36because you are bringing a 27th amendment
03:39to solve many other discrepancies.
03:42Let us assume that the 27th amendment
03:45will be brought in.
03:48What do you want to correct
03:51that was left in the 26th amendment?
03:54First of all, I am listening to you
03:57about the 27th amendment.
04:00I don't know about that.
04:03We will bring as many amendments as needed
04:06until the matter is settled.
04:09By that, I mean that until the interpretation
04:12of the amendment is written
04:15through the judgement
04:18and until a judicial decision
04:21is not taken from another
04:24in a system where decisions are made
04:27on the basis of a single nap.
04:30One bench makes a decision on a single nap
04:33and the other bench makes a different decision
04:36in a short period of time.
04:39Until there is an agreement
04:42that there is a language in the amendment
04:45through which the amendment is written
04:48instead of interpreting it
04:51or until the Chief Justice of Pakistan
04:54decides which district the wheat sack
04:57cannot go to,
05:00or what the price of sugar will be,
05:03or which ward boy can be admitted
05:06in which hospital,
05:09or how much can a hospital cost,
05:12or whether the salary of a doctor
05:15from the U.S. can be this much,
05:18or whether he should return his salary,
05:21until these interpretations are made
05:24in Article 184.3.
05:27Until the Chief Justice of Pakistan
05:30is sent home through a judicial decision
05:33and is told that he did not take a salary
05:36from his son's company
05:39but he could have taken it.
05:42If he could have taken it and did not,
05:45then you would have gone.
05:48When you amend anything
05:51to create an equilibrium,
05:54you create your own externalities.
05:57No one has ever said that
06:00there will be no externality.
06:03If this was the case,
06:06there would be no scope for amendment
06:09in the constitution.
06:12When I was studying in the U.S.,
06:15I found the answer to the question
06:18of what is the genius of the constitution.
06:21After a lot of answers,
06:24I found the answer to the question
06:27of provision for change.
