00:50What is your reaction to the investigation of the House Squad Committee on War on Drugs by the Duterte Administration
00:55and the revelations that are coming out of this?
00:58Rafi, you know, it's a very good thing that this Quadcom hearings and investigation happened
01:06because they're doing precisely what the ICC prosecutor intended to do
01:14if they will conduct an investigation here.
01:17So it's a very positive thing that the legislative inquiry,
01:22which was initially the purpose of the Quadcom,
01:27went home.
01:28More or less, their investigation went home.
01:32That's why the things that happened during the so-called drug war are slowly coming out.
01:39That's exactly the plan of the ICC prosecutor if they went here.
01:45But there are people who are saying that the Quadcom is being taken over by the ICC.

01:52Rafi, in all likelihood, the ICC is monitoring this because they have representatives who are here.

02:24First of all, the ICC cannot exercise jurisdiction over us
02:31because when they started their investigation,
02:35we withdrew more than two years from the Rome Statute or the ICC.
02:41That's why in terms of being able to exercise their jurisdiction, it's really not possible.
02:46We cannot stop the ICC if they still want to investigate.
02:51That's why they have no hope of cooperation on the part of the government
02:56because we don't have a legal duty to do that because we are not members anymore.
03:00But the relatives of the AJK victims are saying that they cannot get justice here in the Philippines
03:06that's why they are sleeping in the ICC.
03:08What is your reaction to this?
03:10I think it's not true, Raffy.
03:13If they did that in 2017, if they filed a complaint to investigate what happened to their relatives,
03:25maybe by this time, their complaints are already in court.
03:28But what they did is, maybe other groups will also object,
03:34they complained to the ICC in 2017.
03:38It's been seven years since 2017, Raffy.
03:43Where is the investigation of the ICC?
03:46Nothing is happening yet.
03:48If they did that here, maybe something will happen by this time.
03:52Some have already arrived in court and some have already been convicted.
03:55It's just a small number.
03:57But the process of investigation and prosecution is still ongoing.

04:08You were part of the Cabinet of the former President Rodrigo Duterte as the Justice Secretary.
04:14Have you heard about the reward system during the drug war?
04:19Raffy, when I was the Justice Secretary, we initiated our own investigation on alleged abuses during the drug war.
04:28The first thing we looked at were the incidents that happened on the ground.
04:32The alleged lapses on the part of law enforcement agencies.
04:36That's why we were not able to reach a deeper investigation.
04:41We were able to finish the administration of President Duterte.
04:47That's why we were hoping that the Department of Justice and other law enforcement agencies
04:53will continue our investigation when I was the Justice Secretary.
04:59It's easier now for them to conduct an investigation because the Quadcom has collected new evidence that did not leak during the last administration.
05:12Probably because the witnesses were afraid that it leaked.
05:16But now, all of them are leaking.
05:18That's why it's easier for the DOJ and our law enforcement agencies to build up a case.
05:26Because the evidence is getting more confusing now.
05:29Aside from the lapses you mentioned, have you heard about the reward system?
05:34Raffy, when we were investigating, we were not able to hear about the reward system.
05:39There were only rumours about it.
05:41But there were no actual witnesses who came forward to say that there is a system initiated by people up there.
05:55That's why we can say that there is a scheme.
05:58We were not able to see that because there were no witnesses who came forward to tell the truth or to say that there is a reward system.
06:09But now, these witnesses are leaking.
06:12Should the DOJ investigate this case and not wait for the Quad Committee to finish the report?
06:19You're right Raffy. The Quad Committee doesn't need to finish their investigation and come up with a report.
06:27Because the DOJ, Ombudsman and other government agencies are monitoring this.
06:34So if they think that there is a reasonable basis for them to take over in parallel,
06:42to investigate the people involved in the Quad Committee investigation,
06:47they have the right and the opportunity to conduct or to initiate their own investigation.
