Muhyiddin fails in bid to review Court of Appeal decision in abuse of power case

Former prime minister Tan Sri Muhyiddin Yassin has failed in his bid to review the decision by a previous Court of Appeal panel that reinstated four abuse of power charges linked to the misappropriation of RM232.5mil against him.

00:00Former Prime Minister Tansri Muhyiddin Yassin has failed in his bid to review the decision
00:05by a previous Court of Appeal panel that reinstated four abuse of power charges
00:10linked to the misappropriation of 232.5 million ringgit against him.
00:16A Court of Appeal, five-member panel chaired by Justice Aziza Nawawi,
00:21said that the earlier quorum had the requisite jurisdiction
00:24to hear and educate the prosecution's appeal that was brought before them then.
00:29The Bersatu President and his lawyer, Datuk Hisham Teh Potek,
00:34spoke to the press after the judgment.

01:03The defence team shared the sentiments expressed by Tansri to say that we are disappointed with the result
01:10or with the decision given by the Court of Appeal recently.
01:14We respect the decision of the Court of Appeal.
01:17We will further study the reasons given by the Court of Appeal.
01:22In essence, the Court of Appeal agreed with substantially our arguments
01:26canvassed before the Court of Appeal the other occasion,
01:29except that the Court of Appeal did not agree
01:32and came to a conclusion that the inherent power of the High Court
01:38includes also what comes within the revolutionary power of the High Court.
01:42On that basis, a new law has been created.
01:46We need time to study the judgment concern
01:50as to the next steps to be taken by the defence team acting for Tansri.

02:04We were confident.
02:06The submissions made by us, both ordered and written,
02:10our submissions were based entirely on law
02:12supported by authorities of both the Federal Court and the Court of Appeal.
02:17And we went on a literal interpretation of Section 51 of the Court's Judicature Act.
02:22And the law is very clear to say that when there is no ambiguity whatsoever,
02:29the literal approach must be taken.
02:31In this respect, earlier on I said again
02:35that we respect the judgment of the Court of Appeal
02:38and we will further study the conclusions made by the learned judges of the Court of Appeal.
02:45So the consequence of it is that Tansri will go back again to the Sessions Court
02:51and we will report to the Sessions Court on the outcome of this proceeding this morning.

02:58Muhyiddin was charged with using his position as the then Prime Minister and Bersatu President
03:03to obtain bribes from three companies,
03:05Bukhari Equity Sendirian Berhad,
03:08Nepturi Sendirian Berhad
03:10and Mamfor Sendirian Berhad,
03:12and also from one Datuk Azman Yusof for the party.
03:16He was accused of committing the offences at the Prime Minister's office in Putrajaya
03:21between March 1, 2020 and August 20, 2021.
