00:00Despite being cited and contempted in the Senate,

00:02Desmiss will still remain in Camp Krames while some issues are yet to be resolved.

00:09That being said, some Senators are asking why in the Regional Trial Court in Kapas, Tarlac,

00:14the case of Graff against Guo is still pending.

00:17According to Senator Francis Tolentino,

00:19Tarlac RTC should not be the one to handle the case

00:22because it is possible that the former mayor might have an influence there.

00:26Because of that, the arrest warrant and the order to imprison Guo in the PNP Custodial Center is not valid.

00:32That is why the Senate should have custody of Guo if there is no arrest warrant from the court.

00:37According to Ombudsman Martyrez,

00:39the Senate cannot fight for Guo's custody

00:42because the court's arrest warrant is heavier than the Senate's contempt order.

00:49As for Justice Secretary Jesus Crispin Remulia,

00:52the Senate should have custody of the case

00:55because it is public official that Guo has a salary grade.

00:59They also clarified this to Ombudsman.

01:02The Tarlac RTC Branch 109, which has custody of Guo's Graff case,

01:06refused to give a statement.

01:08Senator Riza Ontiveros decided to respect the court's decision

01:12until the issue is resolved.
