00:00After the incident in Kolkata, the West Bengal state and the state government are in discussion.
00:27Here, the way a trainee doctor was brutally murdered, the entire country is enraged by this incident.
00:33The entire country wants the accused to be punished in such a way that there is an example in the society.
00:39Today, the West Bengal government has called for a two-day special session.
00:43In this session, an anti-rape bill will be presented.
00:46In this, the death penalty or life imprisonment will be imposed.
00:50But can the Mamata government do this?
00:52Can this new rule be implemented by the state government on its own?
01:03Today, that is, on September 2, a special session of the West Bengal Parliament has been called.
01:07This session will last for two days.
01:09In this session, the TMC government will present a new bill for the death penalty or life imprisonment for the rapist.
01:15The TMC had asked the BJP for support on this bill.
01:18Politics is also focusing on this issue.
01:21The BJP has raised the question that now the Mamata government is bringing this bill to get sympathy.
01:27During this session, there is also a possibility of a riot on Tuesday.
01:30The opposition BJP is already asking for resignation from Mamata Banerjee for the incident that took place with the doctor of R.G. Kerr Medical College and Hospital.
01:44Opposition parties and legal experts have raised questions on this proposed bill.
01:49They say that there is already a strong law against rape in the country.
01:54Then what is the need to do all this?
01:56Central Minister Shantanu Thakur has questioned the West Bengal government on this issue.
02:01They say that why did the state government not bring such a law before?
02:05This bill is being brought to hide the main issue.
02:09This is just a part of trying to get sympathy.
02:12BJP has said to support the law in this matter.
02:21The Chief Minister of the BJP, Sukant Majumdar, said that we have decided that all BJP MPs will support this law of Mamata Banerjee.
02:30He also said that they will continue their protest in the Legislative Assembly on the demand for Mamata's resignation.
02:38Mamata Banerjee, Chief Minister of West Bengal and Chief TMC of Kolkata,
02:45had dedicated the day of the establishment of her party's Student Union to the rape and murder of Kolkata.
02:51She had said that the government will make an anti-rape law,
02:55which will give death penalty to the accusers of such cases.
02:59Mamata Banerjee is demanding for the resignation of the BJP because of the Kolkata incident.
03:09In response to this, the Chief TMC of Kolkata has surrounded the BJP.
03:14Mamata Banerjee said that the Chief Ministers of Uttar Pradesh, Madhya Pradesh and Maripur
03:19have given resignation to the crimes against women in their states.
03:24Mamata Banerjee also said that she had asked for 5 days to solve this case.
03:29But the case was sent to the CBI.
03:31Mamata Banerjee also said that they don't want justice, but delay.
03:36It has been 16 days since the CBI started the investigation.
03:39But where is the justice?
03:45Two months ago, new criminal laws have taken place in the country.
03:49Now, BNS has been implemented instead of IPC in the country.
03:52In the Indian Constitution, section 63, there is a definition of rape.
03:55In addition, in section 64-70, there is a punishment.
03:58In BNS, young people have been severely punished for misconduct.
04:02If a 16-year-old girl is found guilty of misconduct,
04:05the accused will be sentenced to at least 20 years.
04:08This punishment can be extended to life imprisonment.
04:11In addition to this, in section 65, it has been stipulated that
04:14if a person is found guilty of misconduct with a 12-year-old girl,
04:18he can be sentenced to 20 years in jail to life imprisonment.
04:21Even in this, the sentence of life imprisonment will remain until the accused is alive.
04:26Section 66 of BNS says that if a woman dies in the case of rape,
04:30or if she reaches a state of coma,
04:33then the accused can be sentenced to at least 20 years,
04:36and this punishment can be extended to life imprisonment or death penalty.
04:45At present, punishment has already been imposed for all kinds of crimes in the country.
04:49In India, for every crime, punishment will be given under BNS,
04:52which was previously under IPC.
04:54We have already told you who will be punished under this law.
04:58But if the question is whether the state government can make a rule for capital punishment,
05:02that is, death penalty, for its own state,
05:05then the answer to this is no.
05:07The central government can think about changing the rules for capital punishment.
05:12It can say that there are some less things in it.
05:15The state government has no right to give death penalty,
05:18or to impose any rule for its own state.
05:22This right is with the central government,
05:25which can try to work on it under the constitution,
05:28consulting the laws in the country.
