00:21requests for the 86-year-old to be exempted from court proceedings under Section 342 of
00:26the Criminal Procedure Code.
00:28He said a medical report from Asanta Hospital stated that Dayim had suffered multiple strokes
00:34resulting in a hemorrhagic infarct since January 2024.
00:38As such, the prosecution doubted whether he is fit to stand trial and capable of receiving
00:43and giving instructions to his defence team when the trial commences.
00:47The prosecution also doubted whether the facts pledged by Dayim in his previous affidavits
00:52are true or not.
00:53Prosecutor Nizamuddin Abdul Hamid, representing Dayim, objected to the prosecution's request,
00:59arguing that his client was only suffering from physical weakness and not mental issues.
01:04He said a recent meeting showed his client's mental state is still sound.
01:08Judge Azura Alwi then set October 17 to decide whether Dayim needs to undergo a mental examination.
01:15The court also set the same day to hear the application by Dayim and his wife, Topua Naima
01:19Khalid, to refer constitutional questions related to the charges facing them to the
01:24High Court.
01:25Earlier, Judge Azura dismissed Dayim's application to transfer his case before another Sessions
01:30Court judge.
01:32She said Dayim failed to meet the threshold for demonstrating a real danger of bias and
01:36provided no basis to show that the judgement would be clouded, even though Naima was charged
01:42in the same court.
