Transcripción
00:00Medicine is not an exact science, so it cannot predict or ensure favorable results in all cases,
00:07since there are limitations of the professional in the interpretation of the facts,
00:11such as when the clinical picture is not fully manifested,
00:15the patient does not understand the risks and benefits of a diagnostic or therapeutic procedure,
00:20or delivers incomplete information of his symptoms.
00:24In addition, the circumstances in which a clinical relationship occurs can limit it.
00:29Certainty of the diagnosis and the effectiveness of therapeutic measures.
00:33In these conditions, given the great variability and complexity that surround a specific clinical condition,
00:40some are dependent on the professional, others on the particular conditions of the patient,
00:45the resources or infrastructure that is available and, finally,
00:49due to the circumstances that surround it, it is impossible to apply the same normative in all cases,
00:55but these must be adapted to the specific case.
00:58Therefore, it can be said that the Lex Artis Ad Hoc is an undetermined legal concept
01:03that must be established in each case, in which the doctor, through a deliberation process,
01:09applies the measures with prudence to the specific clinical situation and to the measure of the prevailing conditions.
01:15In the orbit of comparative law,
01:17the Civil Court of the Spanish Supreme Court has gradually delineated the term referred to
01:23until it is defined as
01:53deriving from it both the collection of requirements or requirements for legitimation or legal action,
01:58the corresponding effectiveness of the services provided,
02:02and, in particular, the possible responsibility of its medical author
02:06for the result of its intervention or medical act executed.
02:10The Lex Artis Ad Hoc is the valuable criterion that allows us to judge the correction of a medical conduct
02:15carried out by a health professional.
02:18The result of this examination depends on the fact that a doctor is declared responsible
02:22for the negative consequences of the specific medical act for the patient.
02:27Factors that must be taken into account in the so-called Lex Artis Ad Hoc
02:311. Training of the health specialist
02:332. Complexity of the matter
02:353. Previous situation of the patient
02:384. State of medical knowledge
02:405. Formal and protocol fulfillment of the provided techniques
02:456. Implementation of the tests for the correct diagnosis
