Shannen Doherty was determined to finalize her divorce before she died, but she didn't quite make it ... nevertheless, a family law judge gave her a unique, posthumous assist.

00:04Actually, the divorce has been going on for years for years and you know, of course that she passed away on Saturday
00:11But that day before she died there were documents she signed to settle this just finally settle the divorce
00:18And from what we are told from people in her world
00:22Everyone around knew that the end was coming
00:25Well, they knew it was they knew she wasn't gonna make it through the weekend, right?
00:28And so they were there was a mad dash because she wanted and there are financial reasons for this too
00:34But she wanted this divorce to be final before she died
00:38So Laura Wasser her lawyer who is you know represents every celebrity in a divorce

00:48She worked really hard to get a settlement in place which they did on Friday the day before she died
00:54So the settlement was in place and then they filed the documents hoping the judge would sign it on that day because they knew
01:02She was not gonna last the weekend judge didn't sign it and Harvey
01:06This is critical because as you said if you are still married when you when you actually pass away
01:10It has probate implications and that can be a very very messy process people want to have control over how their assets are divvied
01:17Up and by getting the settlement signed by the divorce judge after she died
01:20It was sort of an assist from the family law judge. Well, we didn't say that yet
01:24We should explain Derek that what happens is that once a person dies if they're in the middle of a divorce the family law

01:35It goes over to the probate court and then all the probate court is gonna do is
01:41Figure out who gets what in terms of the will or you know, who's gonna have to pay estate taxes
01:47But you lose the ability to get divorced. So she died married. This could have gotten very very messy
01:54and very sticky but
01:56The judge seems like did her a solid here, right? You and I'm not seeing this. Yeah, I've not seen this in that
02:03Monday the two days after she died
02:06the judge signed the divorce documents the settlement and made it official and it was done posthumously
02:14Yeah, no, I'd never seen anything like this and it's what's interesting is the terms of the settlement which do reflect Shannon's last wishes are
02:21Are now laid out in the settlement agreement that is enforceable so it's good for her and what she wanted it
02:25She got the Malibu residence. She got a Salvador Dali painting and so forth
02:29So now that's baked in rather than having to settle all that in probate court, which can get really really messy
02:34The one thing that we will see although I don't think it's gonna happen
02:36Is that I wonder if he would actually go in and try to challenge this but since he well, I know
02:45The optics of that would be terrible would it be awful? Yeah, but would who knows what's gonna happen?

03:01in a way this really honors her because she wanted this done at the finish line now, there was another very
