Manslaughter raps vs Alec Baldwin over death of cinematographer dismissed

A New Mexico judge dismisses involuntary manslaughter charges against Alec Baldwin on July 12, 2024 (local time) after his lawyers allege police hid evidence of the source of the live round that killed 'Rust' cinematographer Halyna Hutchins in 2021. Three days after Baldwin's trial began in New Mexico, Judge Mary Marlowe Sommer ruled after hearing evidence on the defense request made earlier on the same day. The actor's lawyers said the Santa Fe sheriff's office took possession of live rounds as evidence in the case but failed to list them in the 'Rust' investigation file or disclose their existence to defense lawyers. 'The Colt .45 rounds at the center of the dismissal were handed into the Santa Fe County Sheriff's Office on March 6 by Troy Teske, a friend of Thell Reed, the stepfather of "Rust' armorer Hannah Gutierrez, on the same day Gutierrez was convicted of involuntary manslaughter for Hutchins' death. Prosecutors allege Baldwin played a role in the death of Hutchins because he handled the gun irresponsibly. His lawyers say Baldwin was failed by Gutierrez and others responsible for safety on the set, and that law enforcement agents were more interested in prosecuting their client than finding the source of a live round that killed Hutchins.

00:03It was a disaster for the special prosecutors.
00:06It raises questions about this entire investigation.
00:10You had a judge who was obviously ticked off at all the missteps in the prosecution, and
00:15she finally said the only response, the only logical answer is to dismiss this.
00:20It can't be refiled.
00:21Alec Baldwin will not be on trial any further for the criminal charge of involuntary manslaughter.
00:26Interesting.
00:27Okay.
00:29It was clear that there was evidence that had not been turned over to the defense, significant
00:36evidence in the eyes of the defense and the judge about bullets, and were these the bullets
00:41that could have matched the ones that were in the gun.
00:44And the fact is, is that the special prosecutors and law enforcement apparently made a decision
00:49to not turn this evidence over to the defense.
00:53The judge said, that's it.
00:55The only remedy is to dismiss this entire case.
00:58We could, we don't know enough yet to know what was not turned over in the effect, but
01:01it certainly could have a possible effect on the Hannah Gutierrez Reid appeal.
01:06But again, you know, this calls into question the entire prosecution of all these people
01:11from start to finish.
01:12And it's not, it's not good for the special prosecutors.
01:15New Mexico spent a lot of tax dollars on this.
01:17And at the end of the day, what did the people of New Mexico get for their money?
01:21No, it's just, this was really, it was like watching the Titanic go down.
01:25Unfortunately, the special prosecution case unraveled.
01:27There was a very well-regarded second chair special prosecutor who quit today.
01:32We don't know why, but I think you can assume it had something to do with the facts of this
01:36case and how it was unraveling.
