00:00A US judge has decided that Alec Baldwin's role as a producer isn't relevant in his involuntary
00:05manslaughter trial over a fatal shooting on the set of the western film Rust.
00:10Judge Mary Marlowe-Summer ruled that evidence won't be allowed at trial, siding with defence
00:15attorneys.
00:16I'm having real difficulty with the state's position that they want to show that as a
00:24producer he didn't follow guidelines and therefore as an actor Mr Baldwin did all these
00:32things wrong resulting in the death of Helena Hutchins because as a producer he allowed
00:38this all to happen.
00:40Alec Baldwin's lead attorney argued his client didn't break the law and gun safety was not
00:44his responsibility after Baldwin shot and killed cinematographer Helena Hutchins and
00:50wounded director Joel Sousa during a rehearsal on the set of Rust in 2021.
00:56They say the exclusive responsibility of gun safety is on the prop master, the armourer,
01:01the first assistant director, doesn't say anything about a producer, there are a number
01:05of actors doing the same exact thing that was required by the safety guidelines, those
01:09are SAG guidelines for actors, armourers, the first assistant director and the prop
01:15master.
01:16Baldwin has pleaded not guilty and claims the gun fired accidentally after he followed
01:20instructions to point it towards Hutchins, who was behind the camera.
01:25Prosecutors also want the judge to exclude evidence and arguments designed to garner
01:29sympathy for Baldwin, including indications of remorse or the impact of events on his
01:34family.
