00:05TikTok and its Chinese parent company, Zijie Tiaodong, announced that on Tuesday,
00:08they entered the Washington Special Administrative Region to appeal to the court
00:11in search of a law banning TikTok from being used in the United States
00:14after it overturned a bill signed by US President Biden.
00:17This bill, which was in effect since last month,
00:19is called the No-Sell Bill.
00:21It requires Zijie Tiaodong to sell TikTok's US business to non-Chinese companies
00:24before January 19 next year.
00:28Otherwise, it will be a complete blockade of TikTok in the United States.
00:32It turns out that as the deadline approaches,
00:34Zijie Tiaodong has already shown that he has no intention of looking for a buyer for TikTok.
00:38Zijie Tiaodong's claim in the suit
00:40is undoubtedly that the No-Sell Bill
00:43is equivalent to shutting down the Americans who use TikTok
00:45with 1.7 million people
00:47and prohibiting all Americans from joining
00:49a network platform with more than 100 million people around the world.
00:53This violates the freedom of speech of Americans
00:55and harms content creators and small businesses that use TikTok.
00:59In this 77-page suit,
01:03Zijie Tiaodong pointed out that this bill not only violated the U.S. Constitution,
01:06but also violated the protection of freedom of speech in the Constitutional Revision Act.
01:11Zijie Tiaodong also mentioned in the suit
01:13that the Chinese government has clearly stated
01:15that it does not allow TikTok to be isolated.
01:19Therefore, it is impossible for TikTok to be isolated
01:21in terms of business, technology, and law.
01:24Zijie Tiaodong said that he will not sell TikTok,
01:28but will choose to start a lawsuit
01:31to fight for freedom of speech and national security interests
01:34and defend his rights in court.
01:52The Chinese short video application TikTok
01:54and Zijie Tiaodong
01:56officially sued the U.S. federal government
01:58for widely reporting on U.S. major news platforms.
02:01The U.S. media analyzed
02:03that this lawsuit involving freedom of speech
02:05and national security interests
02:07may be a long judicial battle.
02:10I'm afraid it will take the Supreme Court to decide.
02:21We have a nine-month to one-year deadline
02:23for TikTok to be sold.
02:25This lawsuit could possibly stretch that out
02:27much longer, even years.
02:32In the next few months,
02:34the battle for the survival of the U.S. government
02:36against TikTok will unfold in court.
02:38According to Dr. Peng,
02:40although U.S. officials have always said
02:42that TikTok's algorithm poses a threat to national security,
02:45it may be used by the Chinese government
02:47to carry out large-scale and influential actions in the U.S.,
02:49but they have never provided any evidence.
02:51It turns out that the court is a place for evidence.
02:54This means that the U.S. government
02:56will have to provide evidence,
02:58or even be forced to publicly disclose secrets
03:00or sensitive information
03:02to prove that these concerns are true,
03:04rather than just speculation.
03:06Therefore, the two sides may eventually
03:08fall into a long legal dispute,
03:10and may even continue to appeal to the Supreme Court.
03:12Pengbo Industry Research Analyst Ma Xiuzhou
03:14believes that TikTok has a 30% chance of winning,
03:17but because the judge of the Washington District Court
03:19is not a national security expert,
03:21unless they find that the bill
03:23is clearly a violation of the first amendment,
03:25that is, TikTok's argument
03:27that it violates freedom of speech,
03:29otherwise they may listen to the judgment of Congress
03:31to defend the bill.
03:33The analyst said that
03:35due to the critical deadline of January next year,
03:37the court may speed up the trial,
03:39and the verdict may come out
03:41as soon as the second quarter of 2025,
03:43that is, between January and March.
03:45We will see the result.
