MIL 101 | Kailan nagiging iligal ang paggamit ng kanta o obra ng isang indibidwal?
Transcript
00:00 At present, one of the most common uses of digital media is to be an entertainment platform.
00:07 This includes musicians who upload original music and songs on social media.
00:14 This is a good and fast way to recognize the output and talent of a person,
00:19 especially independent musicians.
00:21 It also puts their songs at risk of piracy and illegal use by various people.
00:30 But how can we avoid this and how can we protect musical creations from new types of piracy online?
00:38 Let's find out here in MIL 101!
00:45 KRS-P, we are not just taking various types of songs and using them for our music production.
00:56 Especially if there is no payment, or sometimes there are payments.
01:00 We really need to have a transaction or talk to the owner.
01:06 Because we might be sued later, and we might be sued for this.
01:14 If a fellow countryman does this, we don't allow it.
01:21 But on the other hand, it's better if we learn how to make our own songs and arrange them.
01:29 And of course, the lyrics.
01:32 Because we Filipinos are music lovers.
01:35 But while we are music lovers, we also need to be responsible for using various types of materials
01:42 that were made by the first to make this.
01:46 Here it is, KRS-P.
01:47 This month of April, when National Intellectual Property Month is celebrated,
01:52 let's talk about music piracy first.
01:54 Director Ralph Jarvis-Alendogan is with us
01:57 from the Bureau of Documentation, Information and Technology Transfer of the IPO Philippines.
02:05 Good morning, welcome to Rise and Shine Philippines.
02:08 Good morning also, Sir T.
02:12 This is Prof. Fee, Sir Ralph, or Director Ralph.
02:17 Before we talk about music piracy, what is piracy and how does it apply to music?
02:27 Well, piracy is the use of songs or lyrics of songs
02:35 that we don't allow to be used in the song or lyrics of the song.
02:43 What is the most common type of music piracy, especially in the Philippine setting?
02:51 Sometimes, we have what we call…
02:57 Go ahead, Sir. We can hear you. Go ahead.
02:59 Yes. Sometimes, we have what we call copying the lyrics or the sound of the existing songs
03:19 in a public space.
03:23 Okay. If I'm an example, I am the original artist.
03:26 What effect does it have on me if someone pirates the lyrics or the sound of my song?
03:33 Well, Sir Toph, what you will do is,
03:38 as the owner and creator of my song,
03:43 or the lyric of the song,
03:48 I can either put it in the Intellectual Property Office of the Philippines
03:56 or I can talk to the person who copied it
04:03 to remove the song from the public space or media sites.
04:15 Alright. Director, is it still considered illegal to download songs
04:20 for personal purposes and not to distribute them?
04:26 Because we have what we call fair use.
04:39 Okay.
04:40 It is still considered illegal to use songs for personal use.
04:57 But basically, we should not copy the works of others.
05:08 So, for instance, if I have a social media platform account
05:14 and I would just use it for the sake of posting, is that okay?
05:19 Yes, that's okay.
05:23 But even if we say that it is a "credits to the owner",
05:26 the so-called "CTPO", it is not a valid reason to use the works of others.
05:38 We should really say goodbye to the owner of the song we made.
05:47 Yes, because even in journalism ethics, it is very vital
05:51 that if we have a video or a picture from a person,
05:55 we should say goodbye to the owner.
05:57 And if this person has the right to pay,
06:00 you will really pay to get that specific visual material.
06:04 Is that right?
06:05 Well, we want to know also, just for the last time,
06:08 what is the punishment for piracy?
06:11 The punishment for piracy under the law,
06:16 we can be punished for a criminal offense,
06:22 it can also be a civil offense,
06:25 and also an administrative offense.
06:30 So, it can be a problem for many people
06:34 who use the works of others.
06:40 Alright, Director Pahabon Lama,
06:42 if for example, the material I got came from abroad,
06:46 what would be the punishment for this
06:48 or what could be the interventions that can be done?
06:52 What can be done is,
06:54 because we have what we call CMOs,
06:58 our collective management organizations,
07:04 they are the ones who take care of the works internationally.
07:10 So, what can be done is,
07:12 before you use a song or the lyrics of that song,
07:17 we will also ask permission from a member of the Philippines,
07:21 for example, I am a member of a CMO,
07:27 we will also talk to the CMOs from other countries
07:30 so that they can talk to us
07:33 so that we can use that song or that act.
07:39 There, so at least we have a chance, RSP,
07:43 to know how to use the songs of others.
07:47 And we should really let the owners of the material know that.
07:52 On that note, thank you so much, Director Ralph Jarvis-Alendogan,
07:56 for sharing with us information about piracy.
08:00 Thank you so much, Director. Have a great day.
08:02 Thank you very much, Sir Tommy.
