Attorneys prepared to make opening statements Thursday at the first trial related to the fatal shooting of a cinematographer by actor Alec Baldwin during a rehearsal for the Western film Rust.

00:20 These witnesses are going to describe the defendant's conduct as unprofessional and

00:26 You will hear testimony that she routinely left guns and ammunition lying
00:30 around the set unattended.
00:32 Ultimately, you're gonna hear from us that there were not just these two, but
00:38 a total of six live bullets that were found on the set.
00:42 But that by failing to make those vital safety checks,
00:46 the defendant acted negligently and without due caution.
00:52 And that the decisions she made that day ultimately contributed to
00:57 Ms. Hutchins' death.
00:59 We found a photograph where there was one occasion where a live round
01:05 was sitting right on Ms. Gutierrez's lap, and she failed to identify it.

01:19 So that gives you an idea of what was going on that morning.
01:23 Alec Baldwin was sitting on a church pew, and he was practicing this draw
01:29 from his holster with the camera crew kind of close up on top of him.

01:38 is trying to blame it all on Hannah.
01:39 The 24 year old, why?
01:43 Because she's an easy target.
01:47 She's the least powerful person on that set.
01:49 When the state talks about Ms. Gutierrez-Reed being negligent,
01:54 what really happened is production was negligent.
01:57 Production put her in that position.
01:59 They put her in the position of having two jobs, a props assistant and
02:04 an armorer, and expected a 24 year old under really tough conditions
02:09 to keep up with everything that was going on.
02:11 You're gonna hear from OSHA that Russ Production did inherit to several
02:16 safety rules that they have to adhere to on set.
02:20 That's why they were fined.
02:22 They gave them the largest fine in the history of New Mexico.
