00:00 Thank you.
00:02 One man walks free for an offence that landed another man in jail.
00:06 Mr Keneally, have you apologised to Mr Moore?
00:09 In February 2021, Daniel Keneally took a call at Newtown Police Station from Luke Moore.
00:14 Mr Moore was ringing to complain about a strip search, but in a formal statement, Keneally
00:19 claimed the caller made threats against a Goulburn detective.
00:23 Mr Moore was charged and spent three weeks behind bars until a recording proved the quotes
00:27 Keneally attributed to him were invented.
00:31 Police withdrew the case and instead charged Keneally with fabricating evidence.
00:34 Are you worried about going to jail, Daniel?
00:36 The offence is punishable by up to 10 years jail.
00:40 At the last minute, his mother, the former Premier, Christina Keneally, provided a letter
00:44 of support, but it wasn't taken into account.
00:47 The Magistrate, Rodney Brenda, handed him a 15-month intensive correction order, meaning
00:51 the sentence will be served in the community.
00:54 You did not plan it, you had no apparent motive, and you were a junior police officer.
00:59 His victim, Mr Moore, says he's disappointed, but not surprised.
01:02 It's actually completely unreasonable that he didn't go to jail.
01:06 He deserved jail and by rights he should have gone.
01:09 As his sentence was delivered, Keneally swayed on his feet and looked down.
01:13 After learning he would be walking free from court, he appeared to hyperventilate.
01:18 The matter's far from over and my client maintains his innocence.
01:22 He's already lodged an appeal.
01:24 He's previously told the court he was tired and struggling to cope with his job.
01:28 It was an honest mistake.
01:29 The case returns to court next week.
