Transcript
00:00 Thank you Mr. Barista for your support.
00:02 Sir, according to rule 94 of Election Rules 2017,
00:05 in the future, the free and hopeful candidates will be able to join the same political party
00:09 that has been allotted the election votes by the Election Commission.
00:12 Now, if the free and hopeful candidates of the Justice Movement are successful,
00:16 then they may not be able to join the Justice Movement. What do you say?
00:20 No, see, as far as the free and hopeful candidates are concerned,
00:23 the rules are not applicable in the notification within three days.
00:27 It is mostly applicable in the Constitution and the Election Act,
00:31 it is categorically mentioned in three days.
00:33 So, they can join any party. Our own party is also an enlisted party.
00:37 They are still waiting for the right time, God willing,
00:39 they will see what plan C we have to keep and they may want to join their own party or some other.
00:45 But, whenever the free and hopeful candidates are elected,
00:48 after the notification of the return candidate, they have three days to elect any party in three days.
00:56 Because, the party they elect, the seats are allocated to that party.
01:02 And, according to that, the balance of the popular vote is calculated
01:06 and according to that, the same number of seats are allocated to the respective party.
01:10 Whether it is a National Assembly, which has 70 seats, or whether it is a provincial.
01:14 Mr. Baris Aghor, do you admit that when the time comes,
01:19 plan C will also be launched, that they have to join their own party or some other party.
01:24 So, that is very much an option on the table.
01:26 Because, the movement is deprived of the electoral sign.
01:28 If it is not elected, it will be a huge loss.
01:32 But, the popular candidates of the Jamaat,
01:34 like Zadgi Mustarid, Beshtar Rehnuma, have been declared as candidates again.
01:38 Section 94 of Election Rules 2017 can also be violated.
01:43 In this regard, your other colleagues, senior colleagues, are also admitting that there is a danger.
01:47 In the political future of the Jamaat, where do you see the Jamaat standing after 14 days of elections?
01:54 Will this be the last nail in the coffin, this section 94?
01:57 No, look, as far as the Election Commission is concerned,
02:01 as far as our party and its sign are concerned,
02:06 even then, the law has been misconstrued.
02:08 And, even if the Election Commission is saying, they are also misconstruing the law.
02:12 The law has only written, it is written in the constitution and in the act,
02:16 it is written by the political party.
02:18 With that, it is not written anywhere, whether that party got a sign or not.
02:22 We were and are an enlisted political party.
02:25 Even today, we are the same.
02:26 And, our internal, especially when our election notification was issued,
02:31 on which we had got the election done on 2nd and 3rd, we had notified.
02:35 Our election notification was not set by the Election Commission,
02:40 the High Court has decided in our favour,
02:43 and not the Supreme Court, in its short order,
02:46 the notification of our election, the entry party's election,
02:49 the notification of that has been set aside.
02:51 The Election Commission, according to what the Supreme Court has decided,
02:56 that if you have not got the election done in this manner,
02:59 then you cannot get a sign, this is a different matter.
03:01 But, the political party is still existing,
03:04 and it is running its internal affairs,
03:06 and for you, to join any political party,
03:10 regardless of whether you have a sign with that political party or not,
03:14 you can join that party.
03:16 You may remember, when the elections were done last time,
03:18 the 4 MPs of KPK, they too had joined the Baap party,
03:23 and they had got the seats.
03:24 So, you can join any party, which is enlisted with the Election Commission.
03:29 The definitions of political party are present in the Constitution,
03:32 and are also present in the law.
03:33 There is no doubt in that, whether you have a sign or not.
03:37 You are saying the right thing, Mr. Gauhar.
03:40 In the law and the constitution, the definition of political party,
03:44 does not make it clear, that if you do not have a political symbol,
03:50 then you are not a political party.
03:51 But, the rules of the Election Act,
03:53 there are a lot of grey areas,
03:56 they are vague,
03:57 there is a need for more clarity.
04:00 And when there is no clarity,
04:01 you have already lost the baton, while searching for that clarity.
04:04 If the Election Commission has done this,
04:06 then what will you do?
04:08 What will be the way to act?
04:09 The doors of the parliamentary politics will be closed on you.
04:12 No, see, after the election, what happens is,
04:15 that, what is written in the Election Act,
04:18 what is written in the Election Rules,
04:19 the way it has to be interpreted,
04:21 that if you come to a political party,
04:23 and you do the election,
04:25 for that, the political party has to be there,
04:28 not the election.
04:29 For instance,
04:30 if you do not have a 5% representation of women in your party,
04:34 you have given tickets, you have got a symbol,
04:36 and if you do not give a 5% representation of women,
04:39 then you will be stopped from getting the symbol.
04:41 If you cannot transfer funds to your account,
04:46 then you will be stopped from doing so.
04:48 This does not mean that the party is not enlisted.
04:52 It is necessary to have an enlisted party,
04:54 and the candidates of that party can join any party.
04:57 Do we not belong to a political party today?
05:00 Has the political party been dissolved?
05:02 Does the political party not have a status of a worker?
05:05 Is the internal affairs of our party,
05:08 the indoor management,
05:09 is it not running according to the party's rules and regulations?
05:12 Our candidates, God willing, will come now.
05:14 They, on the last day,
05:16 and what is the last day?
05:17 We were given the symbol,
05:19 and they were given the symbol without our consent.
05:21 And we were not allowed to choose the symbol.
05:24 And all the people, whether they were provincial or national,
05:28 we were not allowed to choose the symbol.
05:32 And before the Supreme Court decision came,
05:35 we had already chosen the symbol.
05:37 So this is an issue altogether,
05:39 that they have chosen the symbol,
05:41 but after the election,
05:42 God willing, when we will join it,
05:44 we will have the right,
05:45 and at that time the party will decide,
05:47 the core committee will decide,
05:49 and will proceed according to Mr. Khan's instructions,
05:51 as to what we have to do.
