00:00 The President promised Senator Bato de la Rosa that the ICC or International Criminal Court will not issue a warrant
00:09 for those who will enter the country to investigate the Duterte drug war.
00:14 In the midst of the rumors, they are already here.
00:17 Salima Refran and Mav Gonzalez are here.
00:21 [Music]
00:30 President Bongbong Marcos himself assured Senator Bato de la Rosa
00:35 that he is not worried about the rumors that the ICC or International Criminal Court
00:42 is already in the Philippines to investigate the Duterte drug war.
00:44 The President said that the warrants will be issued to him in Malacanang on November 28.
00:51 That's why I can say that if indeed it's true that they are already in the country
00:56 and if indeed their entry is sanctioned by this government, authorized by this government,
01:04 that's why I can say that this government will fight back.
01:08 We asked for reaction from Malacanang regarding what de la Rosa said.
01:13 Although the President said in November that he is studying if the Philippines will return to the ICC,
01:18 this is what he said in the drug war investigation of the ICC.
01:22 It's not right for foreigners to tell us who will investigate.
01:31 We have the police, we have the NBI, we have the DOJ.
01:34 They can do their job.
01:36 And that's really where the conflict is.
01:39 De la Rosa admitted that he has no personal information to confirm
01:42 to the Duterte administration official that some members of the ICC are already in the Philippines to investigate.
01:50 As the PNP chief who carried out the war on drugs,
01:53 he has no plans to hide if the government allows the ICC probe.
01:57 He also doesn't want to be trusted by Senate Minority Leader Coco Pimentel
02:01 because if it's true, the Executive should feel it,
02:04 like the Justice Department or the Commission on Human Rights.
02:07 It's impossible that they won't feel if they're doing an honest to goodness investigation.
02:14 If there's no such thing, it looks like they're not here yet.
02:19 Although, personally, I find nothing objectionable if they're already here.
02:23 The entry of ICC members into the Philippines is being prevented by a lawyer and concerned citizen
02:32 who filed a petition for preliminary injunction in Calbayog RTC in Samar.
02:36 He said that the investigation is just a hypocrisy and international meddling,
02:41 especially since the Philippines has long been separated from Rome Statute.
02:45 The country has no legal duty or obligation to the ICC.
02:50 The Justice Secretary said that the ICC should first ask for their permission before investigating the country.
02:58 They have not made contact with the DOJ.
03:01 It is their responsibility and duty to make contact with the DOJ in accordance with the international,
03:06 the principles of international law.
03:08 But if the Philippines has entered the country, the members of the ICC...
03:13 That's just like research. Research is just research.
03:16 But for it to be used in a legal process, then we cannot do that.
03:20 If there's something happening, it's not a formal thing.
03:22 According to Solicitor General Menardo Guevara,
03:25 the ICC may investigate those who are not going to the Philippines,
03:30 especially if they have help and support from local groups.
03:33 The Bureau of Immigration has information if the ICC is already in the country.
03:38 But the country is arguing that the Philippines has no obligation to assist the ICC investigator.
03:45 For JMA Integrated News, Sarima Refrain.
03:48 And I'm Mav Gonzalez.
03:50 We will continue in 24 Hours.
