00:21 Koberger, meanwhile, is awaiting trial after being accused of the murders of four University
00:26 of Idaho students.
00:27 Madison Mogan, 21, Kaylee Goncalves, 21, Zanna Kernodle, 20, and Ethan Chapin, 20, were found
00:34 slain at an off-campus apartment in Moscow, Idaho, nearly one year ago.
00:39 But an expert said that cell phone activity, a key piece of evidence in the Murdau case,
00:44 could also be used to determine a verdict in Koberger's case.
00:47 Emily D. Baker, a lawyer and former Los Angeles Deputy District Attorney, spoke to The U.S.
00:52 Sun about the Koberger case and what fate could await him.
00:55 "There is so much that we don't know about this case yet," Baker shared.
00:58 Baker said that it'll be important to hear what witnesses said to the grand jury and
01:02 what the other roommates who were in the home knew.
01:04 "I feel that that's going to be some of the most important evidence for the case,"
01:08 she said.
01:09 But she also acknowledged some of the evidence that has been made public through court documents,
01:13 including Koberger's DNA being found at the crime scene and his cell phone being off during
01:17 the time the murders took place.
01:18 "We've seen that kind of evidence come up and be very impactful to the jury," Baker
01:22 said.
01:23 In the Murdau case where, you know, mysteriously, if someone who uses their phone all the time,
01:28 it's all just off during this discrete period of time, the lack of activity can also be
01:32 very telling.
01:33 Baker maintained that the existing public evidence is important, but there is still
01:37 so much not yet known due to the non-dissemination order and sealed court filings.
01:41 In both the Murdau and Koberger cases, cell phones have played a large role.
01:45 For Murdau, he vehemently denied being at the scene of the crime, until cell phone video
01:50 proved otherwise.
01:51 The video was filmed by Paul, 22, shortly before he was killed and showed Murdau at
01:55 the family's dog kennel.
01:56 Ultimately, the video was the convincing factor for some jurors.
02:00 One juror, Craig Moyer, told ABC News that the cell phone video helped convict the disgraced
02:04 attorney, saying he was certain it was Murdau's voice in the clip.
02:08 In the Koberger case, cell phone activity helped investigators place him near the scene
02:12 of the crime.
02:13 Koberger's phone was pinged near the crime scene 12 times in the months leading up to
02:17 the November 2022 murders.
02:19 The phone was also pinged in the area once in the hours after the killings, court documents
02:23 show.
02:24 Further review indicated that the 8458 phone utilized cellular resources on November 13,
02:30 2022 that are consistent with the 8458 phone leaving the area of the Koberger residence
02:35 at approximately 9am and traveling to Moscow, ID, court documents stated.
02:40 Specifically, the 8458 phone utilized cellular resources that would provide coverage to the
02:46 King Road residence between 9.12am and 9.21am.
02:50 Police identified his 8458 number after Koberger identified the phone as his own in an August
02:56 21, 2022, police stop in Moscow, Idaho.
02:59 While there is some clear evidence in Koberger's case, Baker pointed out that anything could
03:04 happen once the trial begins.
03:05 "Koberger's defense is fighting hard over the DNA found at the crime scene," she said.
03:09 "If for some reason, the DNA gets kept out because of how it was collected or how it
03:14 was tested and those things haven't been ruled on yet, that could be huge because,
03:18 while we saw it in the probable cause affidavit, if that doesn't come in a trial, you have
03:22 a much more tenuous circumstantial case," Baker explained.
03:26 As far as the cell phone activity is concerned, Baker said there are many factors at play.
03:30 "We're not talking about a densely populated city like New York.
03:33 We're talking about a much more sparsely populated area," Baker said.
03:37 "So those cell phone towers might ping from miles away."
03:40 These are the types of points that could come into play at a trial, according to Baker.
03:43 The lawyer also noted that Koberger's alibi will also be called into question.
03:47 "We know from court filings that his alibi seems to be that he was out driving alone
03:51 at night," Baker said.
03:52 "That is not an alibi that's going to help him at all."
