Pastor James Nganga on Wednesday spent the night in a police cell.
His lawyer Cliff Ombeta said they rejected attempts by the police to get a blood and a hand-writing sample from the preacher.
Ng'ang'a was arrested and taken to the Gigiri Police Station, moments after his lawyers moved to court with an urgent application seeking to block his prosecution.The application is due to be heard on Thursday morning when the police are also due to charge him in court.
Nganga's co-accused, inspector Christopher Nzio-ka of Tigoni Police Station, was also briefly detained at Gigiri but later moved to the Mu-thangari Police Station.
