President Trump has expressed concern about his lawyers and the loss of attorney-client privilege as fallout over the FBI raid of his personal attorney, Michael Cohen, continues.
"Attorney Client privilege is now a thing of the past. I have many (too many!) lawyers and they are probably wondering when their offices, and even homes, are going to be raided with everything, including their phones and computers, taken. All lawyers are deflated and concerned!" Trump tweeted Sunday morning.
His message echoes one he had posted Tuesday, writing simply, "Attorney–client privilege is dead!"
Despite his declarations, a Washington Post op-ed written by George Washington University law professor Randall D. Eliason argues that the president is wrong because "no legal privilege is absolute….A rule designed to ensure the fair operation of [the justice] system cannot be wielded to undermine it by shielding criminal conduct."
The column goes on to describe the special rules and judicial safeguards that apply to searches of lawyers' properties and concludes by saying, "no one is above the law — not the president of the United States, and certainly not his lawyer."
