Tokyo victim of hospital switched-at-birth mishap wins court case against hospital
A Tokyo man in his 60s who was accidentally given to the wrong parents at birth sued the hospital he was born in. The Tokyo District Court ordered the hospital to pay all damages claimed.
In 1958, he was taken from the hospital by another woman who had just had her own baby in the same hospital a few minutes earlier.
At the age of two, his surrogate father died and they were put on welfare. Later, he had to work in a small factory by day and attend high school by night. After graduation, he worked for a delivery company.
Meanwhile, the other switched baby lived in a rich family and went on to university after attending a prominent private high school. The other three siblings from the well-off family realised the differences in looks and personalities amongst them. Results from DNA testing showed this man had no blood relationship with the others. The other siblings later tracked down their real brother who was born 13 minutes later than the other based on hospital records. A DNA test was taken, proving he was the right sibling.
The chief judge explained the basis of his decision, saying that the baby mix-up totally messed up the victim's whole life. The man led a life that would have been avoided without the mistake. As a result, the suit was settled for 38 million Yen, or some 3 hundred 37 thousand US dollars. The hospital commented on the ruling, saying they will further investigate the judgement and consider an appropriate response.
