TV9 - "Chakravyuha" With RTI Activist S Bhaskaran - 3/3....!

For now, the Bangalore Development Authority (BDA) site row seems to have ended on a happy note for the ruling BJP as Law and Parliamentary Affairs Minister S Suresh Kumar withdrew his resignation following a favourable opinion by the Advocate General.

However, the resignation and its withdrawal have raised many questions. Whether Kumar has got a clean chit or not is being asked in the political circles. The day when Kumar resigned, he had made it clear that he would not withdraw the same until his name was cleared. He had also asked Chief Minister D V Sadananda Gowda to order a probe. However, no probe was ordered.

Instead, the CM sought the Advocate General's opinion on the issue, that too after publicly stating that Kumar had not done anything wrong necessitating a probe.If the CM was so confident of Kumar's actions, what was the need to seek AG's opinion? In such a scenario, how can an AG, a political appointee, be expected to give a contradicting opinion to the CM's stand?

"If the CM or Kumar wanted an independent opinion on the issue, they should have either constituted a Joint Legislature House Committee or a retired HC judge should have been requested to look into the issue. Seeking of AG's opinion in an issue involving the law minister raises many questions," said a legal expert on condition of anonymity.

Also, if Kumar knew he had not done anything wrong why did he resign? He should have presented his case before the CM and the matter would have ended there. But, if he wanted to come clean in the controversy, who has given him clean chit now? The AG has given his opinion to the CM but no independent agency or authority has looked into the issue.

Former law minister M C Nanaiah said, "If he had not violated the norms in getting the BDA site, there was no need for him to resign and there was no need for the CM to seek AG's opinion. He could have presented the facts even without resigning. I think Suresh Kumar acted impulsively."

However, in the last four days after the RTI activist and former BJP worker S Bhaskaran made those allegations, nothing much has changed, except the AG's opinion.

In fact, Bhaskaran is now contemplating to take the issue to the Karnataka HC and that may cause more embarrassment to the government and all those who are accused of taking 'G' category sites in violation of norms.
