00:11:19Nearly a year ago, the Japanese whalers filed a lawsuit in the United States against Sea Shepherd
00:11:25Paul's lawyers have just called with an update
00:11:28The news is not good
00:11:30I mean this is a US court telling international crews that they can't do anything in international waters
00:11:37It's rather strange
00:11:38Captain Paul Watson calls a meeting to share the dire news with his crew
00:11:45Japan has fired their first shot
00:11:49They got the 9th District Court in the United States to issue an injunction against us
00:11:55Defendants, Sea Shepherd Conservation Society and Paul Watson and any party acting in concert with them
00:12:01Are enjoined from physically attacking any vessel engaged by plaintiffs of the Institute of Cetacean Research Kyoto
00:12:08The injunction prohibits the Sea Shepherds from doing three things
00:12:12Physically attacking any whaling vessel
00:12:14Navigating in a way that puts any whaling vessel in danger
00:12:17And getting closer than 500 yards to a whaling vessel
00:12:20This is just one step down from the United States Supreme Court
00:12:24So they have an incredible amount of power
00:12:28Past Antarctic campaigns have included actions not prohibited by the injunction
00:12:34Prop followers

00:12:36Throwing butyric acid at close range
00:12:38And ship maneuvers that have often led to collisions

00:12:43So this ruling not only affects their engagement at sea
00:12:47But as word spreads they learn it also may affect them at home

00:12:54Potentially there could be a lawsuit that could go after all the assets of Sea Shepherd
00:12:59And as individuals you as well could have your individual assets gone after
00:13:03So it creates a little element of danger legally for every person on the crew
00:13:07Especially for American citizens
00:13:09If you are willing to put yourself on the front line
00:13:14Then you need to do so being fully aware that there could be consequences to that
00:13:19If any of you are not really sure about it and you want to leave you have time now to decide

00:13:30Crew members of each vessel will have to consider if they're willing to face severe legal and financial ramifications
00:13:38It's one thing to like say you know I'm willing to die for whales
00:13:42And then it's another thing to like actually come face to face with a long term repercussion of what we're doing

00:13:51If the injunction were violated
00:13:53Crew could be held in contempt of court and arrested
00:13:56The court could impose penalties ranging from large fines to potentially the seizing of personal assets
00:14:02Everybody when they sign on with Sea Shepherd knows that there's risk involved
00:14:06But if we end up in court or jail that could affect the rest of your life
00:14:13Personally I'm extremely close to my family
00:14:15I've got a life outside of being on the ships
00:14:19And you know this can jeopardize all that
00:14:24As morning light breaks the Sea Shepherd's discovered that the injunction has claimed its first casualty

00:14:41Helicopter pilot Roger Danner has chosen to leave the campaign
