00:00are the other states where minorities are in large numbers responding?
00:05Jammu and Kashmir, Kerala, Tamil Nadu, how are these where your government is not in power
00:11and minority has a style?
00:14How are you reassuring these states, firstly, the people of the states,
00:18that the rights of the largest minority in this country are safe,
00:24that they are not going to be victimized?
00:26Plus, how are the leaders of these states responding to this?
00:30First of all, when we say Muslim community,
00:35large section of Muslim community are wholeheartedly welcoming this act.
00:41The requirement for change in the WAF Act,
00:46the necessary amendment which we have made,
00:50are in fact suggested by the committees which were formed during the Congress time.
00:54If you see 1976, the inquiry report and then the Sachar committee report
01:02and then K. Rehman Khan report, that is a select committee again in the parliament.
01:07They all have talked about making the management of the work property
01:12in much more efficient, transparent and accountable manner.
01:16That is exactly what we have done it.
01:18And then, the work properties in India are the largest work properties in the world.
01:26It is not only in the country.
01:28Some people keep saying that after railways and the defense.
01:33How can you compare the defense and railway properties with the work properties?
01:37Work properties are owned, managed by private individuals.
01:41Railways is like the track, railway tracks, thousands of kilometers.
01:44We travel on that.
01:46The railways don't use it.
01:47They use it for us.
01:49Defense is for the people of the country to safeguard India's interests,
01:54safeguard its territory.
01:56So, first of all, the work properties in India is the largest in the world.
02:01And despite having the largest work properties in the world,
02:04how come these properties are not being utilized for the welfare of the Muslim communities?
02:09See, the purpose is three, you know, for charitable, pious and religious purpose.
02:16So, if so much of work properties are being mismanaged by few of the powerful people
02:23who are, you know, in a very surreptitiously mishandling the entire work properties
02:31and few families are enjoying the fruits of these properties,
02:36what about the 90 percent, the larger section of the Muslim community,
02:40the weaker sections, the children, the women?
02:43So, what we have done is, we have made sure that the misuse will be prevented in future.
02:50And, Smita Ji, I must tell you, we knew it, we will have this kind of resistance.
02:56Because those powerful people who are misusing so much of work properties
03:02will definitely not give up easily.
03:05They will resist.
03:06And that is what we are seeing it.
03:09But what we are saying is, let people read the provisions of the Act
03:14and tell us if there is any provision which harms the Muslim community.
03:20Tell us.
03:21So, Muslims are also Indians.
03:23Shouldn't we think about Muslim community?
03:25How can we leave aside one community
03:28and, you know, let all the irregularities keep on happening unchecked?
03:35We can't see that.
03:36We are the government of India.
03:38We have the responsibility to ensure that every citizen is taken care of,
03:44every community is looked after.
03:46So, the people who are spreading this false news,
03:50all this, you know, unverified claims
03:53and just merely broadcasting around that the work properties
03:58means the masjids, the dargahs, the kabarshan,
04:04these are going to be snatched away by the government.
04:06This country rules through a law.
04:10We are governed by the constitution.
04:12How can anybody snatch somebody's property like that?
04:15You know, when the farm bills came
04:17and when the NRC regulation that was going to come,
04:22there was a lot of street protests which happened
04:24and farm bills were revoked
04:27and the NRC has gone into cold storage.
04:30That has not happened.
04:32What are the chances that the way the street protests are happening,
04:35CAA you did.
04:36You stuck by it.
04:37It happened and the protests died down.
04:40Maybe because COVID happened or whatever.
04:42God knows what the reason was.
04:44But all the funding stopped for the CAA for the protests.
04:48Nobody knows what happened.
04:50But the CAA protests fizzled out.
04:52But the farm bills went into revoke mode
04:55and NRC went into cold storage.
04:58What happens if the current protests against the Waqf bill
05:02also becomes widespread?
05:04Is there a chance that they would be revoked too?
05:07No, we can't be comparing the farm laws
05:13with the Waqf Amendment Act.
05:17These are two different things.
05:19Here in the Waqf Amendment Act,
05:23it is a question of not only ensuring justice to the needy people,
05:29but preventing the wrong things, wrongdoings,
05:33the illegal acts by some of the people.
05:36In fact, I must tell you,
05:39for last nearly eight, nine months,
05:43I have been receiving numerous delegations
05:47from the Muslim community
05:48urging urgently to pass this Waqf Amendment bill.
05:53And then finally we passed it.
05:55So it's not that we just came out of blue.
05:57And the consultation process has been widespread.
05:59Then who are the people who are protesting?
06:02Protesting is only the opposition parties,
06:04those political parties
06:06which treat the Muslim community as vote banks.
06:10They create, you know, fear-mongering.
06:12They keep scaring the Muslim community.
06:14And from the long time I have been witnessing these people,
06:18they don't want Muslim community to develop.
06:21They want to keep them isolated,
06:23create fear in their mind,
06:25and then make them anti-BJP.
06:28But many of the Muslim communities are now coming forward.
06:32I have met so many Muslim communities,
06:34even when I went to Kashmir also,
06:36so many, you know, common people,
06:39they came, the Muslim women,
06:41the influential people also came to me
06:43and they said,
06:44very well done.
06:45The Waqf Amendment bill passed.
06:47Similar to what happened in Article 370
06:50when people in Kashmir came and said.
06:51Same thing,
06:52I had just compared in one of my speech also
06:54that during the abrogation of the Article 370,
06:58they said there will be bloodshed in German Kashmir
07:01and some parts of the country.
07:04And then when CAA was being considered,
07:06they again said that this will lead to snatching away
07:09the citizenship status and other rights of the Muslims.
07:12Now, nothing such has happened.
07:15In fact,
07:16the Citizenship Amendment Act has been
07:19now a kind of a ground
07:21where we are more easily identifiable
07:25with those people
07:27who are genuinely coming to India
07:31and recognize their citizenship
07:32and those illegal are being prevented.
07:36And similar in JNK,
07:37we are seeing the ushering of peace and development.
07:40I was thoroughly enjoying my Kashmir visit,
07:44three days visit this time.
07:46And then it was a fantastic record numbers
07:48of tourist investment,
07:49everything's coming.
07:50This whole thing about
07:52what is going to happen to the Waqf properties,
07:54of course, you mentioned that.
07:56But Mr. Ovesi has said that,
07:59Barrister Ovesi has said that
08:00now Sambhal, Gyanwapi, Mathura,
08:03they'll be removed from Waqf control
08:05and there'll be an attempt to seize these
08:08because it's sensitive
08:10and other religious properties.
08:12And then there are people from,
08:13you know,
08:14the BJP also some hothead saying
08:16So, first of all,
08:18I fail to understand
08:20how could they connect
08:21this Waqf Amendment Act
08:24with other religious issues.
08:28This Waqf Amendment Act
08:31is a continuation
08:32or in a way
08:34it's amending
08:35a previous provisions
08:36which were in existence.
08:38Since 1913
08:39from the British time,
08:40the law existed
08:42and post-independence
08:44first law was enacted
08:45in 1954.
08:47So, the Waqf law
08:49has been there.
08:50The legislative process
08:51has been happening
08:52pre-independence
08:53and then last amendment
08:55was 2013
08:56and that triggered
08:58the present step
08:59which we have taken.
09:01And, you know,
09:02I don't need to elaborate
09:03on those things
09:03but still I would highlight
09:05two important points.
09:07One is like,
09:08you know,
09:09this Waqf by user
09:11without the law
09:13of limitation
09:14being applied,
09:15any property
09:18can be claimed
09:19as Waqf property
09:20on the basis
09:21of a claim
09:22made by an individual
09:23that some
09:24hundred years back
09:25or few years back
09:26we used to do
09:28certain things
09:29namaj or whatever.
09:30You can do namaj
09:31anywhere
09:32but that doesn't mean
09:33that that particular area
09:34becomes a Waqf property.
09:36So, we have
09:37not only checked it
09:39but ensured that
09:40misuse
09:42or, you know,
09:44unverified claims
09:45must be stopped.
09:47So, what we have done is
09:48that you have to,
09:50you can create Waqf
09:51through a deed
09:52not by just
09:53oral claim
09:54because once Waqf property
09:55means forever Waqf.
09:58That is why
09:58you have to be
09:59extremely careful.
10:01So, it has to be
10:02with a documentation process
10:03you can create Waqf.
10:05And then, you know,
10:06this...
10:07And retrospective
10:08Vuvala Path?
10:09See, there are some
10:10confusion
10:11with regards to
10:12the retrospective effect.
10:14First of all,
10:15the law
10:15is prospective.
10:17Whatever
10:18is a declared
10:19Waqf property
10:20cannot be disturbed.
10:22Whether it is
10:23it was
10:24Waqf by user
10:25or whatever
10:26if that particular
10:28property
10:29is declared
10:30suppose
10:30I'll just give you
10:31an example.
10:32If there was a
10:33Waqf by user
10:35and the particular
10:37property
10:38has been declared
10:39a Waqf property
10:40and a document
10:41has been created
10:42thereby the state
10:43government
10:44or the
10:44DM has
10:46recognized
10:46the property
10:47and it is registered
10:48then it is done.
10:50The case is settled.
10:51You are not going
10:52to reopen
10:53or change
10:54the status of that.
10:55only those
10:57cases
10:58which are
10:59pending
10:59under dispute
11:01so they are
11:02either pending
11:02in the
11:03tribunal
11:04or under
11:04writ
11:05they have made
11:06appeal in the
11:08court
11:08these are to be
11:09decided by the
11:10courts.
11:11We can't take away
11:11the rights of the
11:12courts.
11:13So
11:13it is
11:14prospective
11:15it is not
11:16retrospective
11:17however
11:18if
11:20there are
11:21some kind of
11:22issues
11:23which are not
11:23settled
11:24then state
11:25government will
11:26decide.
11:26So the power
11:27is not with the
11:28central government.
11:29Central government
11:29is just
11:30forming a
11:31central Waqf council
11:32which is headed
11:33by the
11:33minister
11:34in this case
11:34me.
11:35So all this
11:36whether it is
11:37to be claimed
11:37reclaimed
11:38counter claimed
11:39by the state
11:40government
11:40will be decided
11:42by state government
11:43the DM is under
11:44the state government.
11:44Why by you
11:45why not a
11:46Muslim?
11:47I mean if
11:47this is about
11:48a Waqf council
11:49why a non-Muslim?
11:51Now the problem
11:51is we have
11:52six minority
11:53communities
11:53in India
11:54by definition.
11:56By notification
11:56there are
11:57six communities.
11:59By virtue
11:59of being
12:00the minister
12:00for minority
12:01affairs
12:01I presented
12:02the bill.
12:03So by
12:04virtue of
12:04being the
12:05minister
12:05I become
12:05the chairman
12:06of the
12:06central Waqf council.
12:08Minority
12:09ministry is
12:10not for
12:10Muslim.
12:11That is
12:12what I have
12:12been telling
12:13from the
12:13beginning
12:13that the
12:14Congress
12:14party had
12:15made the
12:16minority
12:16affairs
12:16ministry
12:17as a
12:17Muslim
12:18affairs
12:19ministry.
12:20How
12:20unfortunate
12:20that is.
12:21And then
12:22they are
12:24talking only
12:24about Muslims
12:25leaving aside
12:26the other
12:27smaller minority
12:28communities.
12:28But you
12:29have left
12:29aside the
12:30Muslim
12:30community
12:30completely.
12:31No.
12:31You don't
12:32have even
12:32one MP.
12:34Though I
12:35have been
12:35telling in
12:36the Muslim
12:36areas that
12:37please vote
12:38for BJP
12:38send Muslim
12:40MPs
12:40come to BJP
12:42and you know
12:43be part of
12:43the government.
12:44if Mohdiji
12:45has got the
12:46massive support
12:47from the
12:48people of
12:48the country.
12:49So it's
12:49a Muslim
12:49community's
12:50fault.
12:51So it is

12:53elected a
12:54BJP Muslim.

13:14objections I
13:15mean this

13:18argument they
13:19said that
13:19the minister
13:20who presented
13:21the bill is
13:22not a Muslim
13:23and on the
13:24counter side I
13:25said that I
13:26feel fortunate
13:27to do something
13:27good for the
13:28Muslim community.
13:29So because of
13:30being a minority
13:31affairs minister I
13:32have the
13:32responsibility to
13:33look after the
13:34welfare measures
13:35of six
13:36minority
13:38communities.
13:39so this
13:40argument doesn't
13:42stand you
13:43know.
