00:00International Criminal Court is now in session.
00:03Rodrigo Roa Duterte.
00:13The lead counsel of former President Rodrigo Duterte,
00:17who has no obstacle,
00:19has been convicted of asking for an interim release
00:24or temporary release of his client.
00:27From The Hague, Netherlands,
00:29we have on the spot, Mariz O'Malley.
00:31Mariz.
00:36Connie, the defense team of former President Rodrigo Duterte
00:39believes that the International Criminal Court
00:42will give them time to ask for an interim release
00:45for the former president.
00:50The lead counsel,
00:52Atty. Nicholas Kaufman,
00:54gave the former President Rodrigo Duterte
00:56permission to be released while the case is still being investigated.
01:00He said that he will not be a threat even if he is released first.
01:03The first of which is the risk of flight.
01:05The second of which is the risk of interference of witnesses
01:09with the evidence.
01:10And the third of which is the risk of continuing crimes.
01:12None of those factors exist in the present situation.
01:14So there is a right for Mr. Duterte to be released.
01:17Although it is not known when they will be released,
01:20they are already working on asking for an interim release.
01:23Kaufman also said that they will convince the pre-trial chamber judges
01:27that there is no jurisdiction of the ICC in the case
01:30because the withdrawal of the Filipinas to the ICC has already been effective
01:34before the investigation can even begin.
01:36There is a compelling argument that the court cannot exercise its jurisdiction
01:40over the Philippine situation.
01:42That is a live issue.
01:43It's an issue which has been through the Philippines courts.
01:45It's an issue that's been through the ICC as well.
01:48It is a compelling argument.
01:50It's an argument of the defensive race.
01:52This is something that's been argued over the last number of years.
01:56We are still trying to get a trial for this prosecution.
02:00But they have already insisted that it is still within the jurisdiction of the ICC.
02:04Even the International Criminal Court said that they have jurisdiction
02:08over the crimes that were committed before the Philippines withdrew from the Rome Statute.
02:12So the court's jurisprudence has already indicated that the ICC retains jurisdiction
02:20even after the withdrawal of a state,
02:23but only for the crimes that were allegedly committed during the period
02:27when the state was a state party to the ICC Rome Statute.
02:31A withdrawal does not affect these obligations and this jurisdiction of the ICC.
02:37According to the defense, if the judges are still in favor,
02:40there will no longer be a confirmation of charges hearing in September.
02:44Today, Kofman was again imprisoned.
02:47He went under for the operation, but he is now fine and can defend the former president.
02:53Kofman has known the former ICC Prosecutor Karim Khan for a long time.
02:58He was previously arrested as a competent lawyer.
03:02So the question is, will their stand in court be strong?
03:18Mr. Khan's duty is to ensure that justice is done, and I trust that he will do that.
03:23Duterte thanks those who support him, while talking about not being aware of the case.
03:30It was a huge outpouring of support and love, both in the Philippines and here in the Netherlands.
03:36And that has touched him, he's been made aware of it, and he's very grateful for that.
03:41The family wants to make it clear, and he endorses this,
03:44that there should be no interference of the judicial process.
03:48The political politics is one issue.
03:50There should be full respect for all participants in that process,
03:54the prosecution, the defense, and the victims,
03:57counsel, who will make their submissions in due course.
04:03Connie Bagamat, in high spirits, said that Attorney Kofman
04:06that it is still difficult to adjust the former president inside the ICC detention facility,
04:13especially since he's 80 years old and is still suffering from various illnesses.
04:16And that was the latest news from the Netherlands.
04:20Back to you, Connie.
04:21Thank you very much, Maryse Umali.
