The Supreme Court has halted an Allahabad High Court ruling that stated "grabbing breasts" and "breaking the strings of a girl's pyjamas" do not qualify as rape or attempted rape. Taking suo moto cognisance of the controversial order, which sparked public outrage, the Supreme Court criticised the judgment for its lack of sensitivity.

00:46Well definitely Sneha when the Allahabad High Court order had come out making the
00:51making the remarks that it made in its order and the observations that were made in that
00:56order, you know there was a huge debate around it, the order was called out,
01:01criticised and even lawyers, several lawyers that we've spoken to had told us that the judge
01:04has been completely insensitive, especially in the case where we're talking about a case of
01:09sexual offence against a minor child, now the Supreme Court decided to take
01:15pseumotocognizance after a letter was written by a senior lawyer and an organisation,
01:20flagging the order and asking the court to take pseumotocognizance, the court has to
01:25state the remarks in three of the paragraphs, calling it insensitive, we're talking about the
01:30remarks as you read out which included observations like even grabbing breasts of a minor,
01:36of the minor girl, undoing her pyjama strings, grabbing her, dragging her to the culvert etc.
01:41would not be enough for the charges for them to raise, so all these observations as of now
01:47have been stated, the court has issued notice to Union of India and the state of UP who will
01:51have to file their responses and the court is likely to hear this case again after two weeks,
01:56but definitely a big order from the top court considering the very first hearing they've decided
02:01to take a call and state these observations as of now, back to you.
