00:00At a minimum, there has to be due process for people to show that they're not even members
00:12of the gang.
00:13There are reports now coming out that many, many of the people that were sent to El Salvador
00:18are not actually members of the gang, are named plaintiffs, dispute that they were members
00:22of the gang.
00:23And so I think what we're going to see are many, many people being falsely accused of
00:27being a member of this gang.
00:28And what that means is they could end up in a Salvadoran prison for a year, two years
00:32of their whole life.
00:33And I think for those of you who have seen the video of how the men were treated when
00:36they got off the plane and the human rights reports about Salvadoran prisons generally,
00:41they're going to be in real trouble.
00:42But what I tried to stress to the judge today is that that's not enough just to give them
00:47a chance to show that they're not a member of the gang.
00:50The Alien Enemies Act should not be used at all against the gang.
00:53It is very dangerous.
00:55Every nationality and ethnic group in the United States has some organized crime gang.
01:03And so that all of a sudden, if the president's power were unreviewable under this act, then
01:09anybody could be termed an alien enemy, saying you're a part of this gang or that gang, and
01:15we're going to send you to a Salvadoran prison.
01:17So I think the implications of the government's position are staggering.
01:23Have you been in touch with the people who were sent to El Salvador?
01:27Do you have any idea what sort of conditions they all did?
01:29Well, we have no way of connecting with the people in El Salvador.
01:32We're connecting with families, but obviously they can't connect with people.
01:36I mean, not only are the conditions brutal, but they're incommunicado now.
01:42What we heard in the courtroom today, today they seem to make a concession that these
01:46people are entitled to some type of due process.
01:49They weren't denying them.
