Blake Lively is following the same game plan as her husband Ryan Reynolds ... officially asking a judge to cut her out of Justin Baldoni's lawsuit.

00:00To Blake Lively and her filing, following suit with what her husband did earlier this week,
00:07she has now filed a motion to be dismissed from Justin Baldoni's lawsuit,
00:12which is the defamation suit he filed against Blake, Ryan Reynolds, her publicist, the New York Times.
00:20But Blake says she should be cut out of this whole thing
00:24because what Justin is doing to her by suing her is actually unlawful, in California at least.
00:32And she cites the fact that she says he's only suing me for defamation
00:38because I alleged sexual harassment in the workplace.
00:42And she's saying I am protected that under California law,
00:47you cannot sue me, go after me in a court of law like that when I have merely reported you for sexual harassment.
00:56Right, except what he's saying, neither one of these are going to fly.
01:02The motions to dismiss.
01:04Number one, he's saying I didn't sexually harass you.
01:08So he's not saying how dare you, he's saying you're lying.
01:12But there's a difference between saying you're lying and then suing her for saying that.
01:16If somebody makes a claim and it's false, you're not protected against a lawsuit
01:22where somebody tries to convince a jury that this was a lie and therefore defamatory.
01:28So that's number one.
01:30But number two, these are questions of fact.
01:33And you've got to remember, Blake is the one who started it.
01:36She's the one who sued Justin.
01:39Well, first she filed a complaint.
01:41Right, and then she sued.
01:43And then she sued him.
01:44And what Justin is saying is a smear campaign right back at you.
01:49You conducted one against me and Ryan Reynolds got me fired from my talent agency.
01:55We should say, by the way, she's the one who mentioned a smear campaign first.
01:58Right.
01:59In her lawsuit, she alleged that Justin started a smear campaign against her
02:03once she reported the sexual harassment while they were shooting.
02:06These are questions of fact for a jury.
02:09And they keep pointing the finger at each other like you're the bully.
02:12No, you're the bully.
02:13Because remember, Justin Baldoni, in his lawsuit,
02:16he claimed that Blake and Ryan were bullying him
02:20and using their Hollywood contacts to, you know,
02:23really suppress him in the making of the movie that he directed,
02:27which also he starred in.
02:29And remember, like he said, that she used Taylor Swift and Ryan Reynolds
02:33to come after him and, you know, make him feel like worthless in this movie.
02:38Well, she's also responding to that in these documents saying like,
02:42no, you're actually the bully because you're trying to silence me
02:46when I am just bringing up sexual harassment.
02:49So it's like, who's the bully here?
02:51Like, it's just we're all so confused.
02:53Wow.
02:54Here's the thing.
02:55Most of these, all of these motions to dismiss, almost all of them fail.
03:00This will, too.
03:02And I know I've had two predictions today on what judges do,
03:06and I never do this, but these are questions of fact for the jury.
03:10Judges don't dismiss based on questions of fact.
03:14They can only do it based on law.
03:16And if her position is, well, you're challenging me on the sexual harassment,
03:20if his claim is it didn't happen and you defamed me by claiming it did,
03:26that's going to be a question for the jury.

03:34Honestly, they have to throw whatever they can at the wall to see what sticks at this point.
