00:00First in our news, a legal expert explained the case of Crimes Against Humanity

00:08that is being faced by the former President Rodrigo Duterte, Gavriel Yegas of PTV Manila in Balitang Pambansa.

00:17This Friday, the former President Rodrigo Duterte joined the International Criminal Court

00:22because of the complaint of Crimes Against Humanity because of the bloody drug war in his administration.

00:28But what is Crimes Against Humanity?

00:31According to Article 7 of the Rome Statute,

00:33Crimes Against Humanity is a broad or systematic attack against the civilian population.

00:39According to the dean of the University of St. LaSalle College of Law in Bacolod City,

00:43Attorney Ralph Sarmiento,

00:45the so-called case of those behind the crime are far from it.

00:49Primarily what we are trying to protect here and what we are trying to punish are direct attacks against the civilian population.

00:57Some of the elements that should be seen to enter Crimes Against Humanity

01:01are the former President, Actos Rios,

01:03where the perpetrator is said to have killed one or more people.

01:08Contextual element, if the killing is part of a broad or systematic direct attack against a population

01:16and mens rea, or the perpetrator knows that his action is part of a broad or systematic attack.

01:24Because in September, the first trial against the former President was scheduled,

01:28the prosecution and defense have a long time to prepare their evidence and witnesses.

01:35They need to establish charges in the International Criminal Court

01:39that they have sufficient evidence or witnesses to establish each and every charge against the former President Rodrigo Duterte.

01:48Now, if they cannot prove that they have sufficient evidence,

01:51then it's a ground that it is possible that the charges against him will not be confirmed.

01:56And if there are no charges that can be confirmed against him, then it will result in a dismissal of the case.

02:02If the charges against him can be confirmed,

02:05then the confirmed charges will be filed in the trial division or trial chamber.

02:14When it comes to the length of time that the case will run in the ICC,

02:18San Miento also said that it depends on the availability of the witnesses and the schedule of the court.

02:24Now, whatever the outcome, it can still be filed in the trial chamber of the ICC.
