00:28Associate Justice Ami Lazaro Javier commented on this issue.
00:59In the 2021 financial statement of PhilHealth that was audited by COA, PhilHealth paid 1.16 trillion pesos to the beneficiaries,
01:09while its asset is only 347 billion pesos.
01:13This means that PhilHealth has a deficit of more than 816 billion pesos.
01:18According to the adverse opinion of COA, PhilHealth did not follow the correct accounting standard and their deficit is likely to be bigger.
01:27Financial statements do not present fairly the financial position of PhilHealth.
01:34In short, the negative equity of PhilHealth may be way more than 816 billion pesos.
01:42Even if you double up your assets, they're not enough to pay off your liabilities.
01:48The deficit slowly decreased to 26 billion pesos in 2022, but it's still a deficit.
01:56From these assets, the law requires PhilHealth to set aside a portion called reserve funds,
02:06precisely to cover payments for the claims of beneficiaries.
02:13And that portion has to be used exclusively for the claims, to pay the claims of the beneficiaries.
02:25And if there is an excess, then additional programs should be set up.
02:31And if there is still an excess in the excess, then investment may be made.
02:39But PhilHealth said that they will not pay all the debts at the same time.
02:43This is the only way to collect the direct contribution of the members.

03:33Outside the Supreme Court, the petitioners asked why they are asking the government to return the PhilHealth's 60 billion pesos.
03:42The fund is not enough, it has been repaid.
03:46The government has abandoned its responsibility to give subsidies to indirect contributors,
03:56to the indigent, and now it is asking for contributions from the workers.
04:02It is clear that PhilHealth's fund is not enough for its reserve fund.
04:08It is not enough to say that as long as PhilHealth has a balancing fund, it is an excess fund.
04:14Earlier, Dr. Tony Leachon also filed a petition against the government and Congress for giving a zero budget to PhilHealth for 2025.
