00:22demand is punishment for rape have been enhanced to reflect the severity of the crime. Enhanced
00:29penalties including stricter life imprisonment provisions and a faster appeals proposes for
00:35extreme cases will act as a strong deterrent for the offence of rape. The proposed amendment
00:42prescribes number one minimum punishment that is rigorous imprisonment of for life.
00:48Number two maximum punishment that is death penalty. It proposes that any fine imposed
00:56should be fair and reasonable to cover the medical expenses and rehabilitation of the victim.
01:04Number two addition of provision for special courts dedicated to sexual violence cases in
01:11protection of children against sexual offence and Bharatiya Naya Sanghita. So why the delay in
01:17enacting the legislation? Our demand is matters for criminal law fall under the current concurrent
01:25list in schedule 7. Both union and state governments can legislate on this matter.
01:32The Aparajita Women and Child West Bengal Criminal Laws Amendment Bill 2024 was passed
01:38unanimously by the West Bengal Legislative Assembly with the opposition's full support
01:44on 6th September 2024 and on the same day West Bengal Governor reserved the bill for
01:50presidential consideration. Governor's role under article 200 upon passage by the state
01:58legislature the bill is presented to the governor. The governor has three options. Number one
02:03assent to the bill. Number two withheld assent. Number three reserve the bill for presidential
02:10consideration as done in this case. So and what does the bill change actually? This bill seeks
02:18to mandate swift streamlined procedures for handling rape cases ensuring justice is neither
02:25delayed nor denied by implementing clear timelines for investigation and trial. This bill seeks to
02:32reinforce public trust strengthen the deterrent against such heinous crimes. It mandates the
02:38completion of investigation and the filing of charges within 21 days of registering the first
02:45information report. Current provision allows two months. Number two the completion of trial
02:50within 30 days from the filing of charges.
