00:22The House Committee on Ways and Means nominated the two Chinese officials
00:27of the National Grid Corporation of the Philippines, or NGCP, to report to the Communist Party of China.

00:51The committee recommended that the NGCP chairperson be called a Chinese national.
00:57The committee also emphasized the ownership and management of the NGCP.
01:02According to the Constitution, only up to 40% of foreign ownership should be held by any public utility.
01:10But the committee said, aside from 40% of the NGCP, which is owned by the State Grid Corporation of China,
01:18foreign ownership is held by a different percentage.
01:22The Synergy Grid and Development Philippines, which owns 60% of the NGCP,
01:28has more than 7% foreign ownership.
01:32We're also questioning the legality of their stature
01:39because they're violating the law of the PSA and the Constitution
01:46regarding the 60-40 ruling when it comes to public utilities.
01:50The NGCP is also reviewing the payment of taxes.
01:54For now, the NGCP is only paying franchise taxes,
01:59unlike other public utilities that also pay corporate income tax, VAT, and others.
02:06Is that enough to revoke the franchise?
02:09I think there needs to be a reorganization
02:13to reestablish Philippine ownership of NGCP and Filipino management.
02:19We request that NGCP give it time to submit a response to address the concerns of the committee.
02:26The committee is also pushing for a retroactive refund of the National Grid Corporation of the Philippines
02:32to consumers, including the disallowed expenses of the NGCP
02:37and the 3% franchise tax of the NGCP
02:40that was approved by the Energy Regulatory Commission
02:43to be paid to consumers in 2011.
02:48In 2018, the commission reversed the decision,
02:51but the refund was only decided in 2023.
02:56What the committee wants is not only the 204 billion pesos
03:00that the NGCP earned from 2016 to 2020 to be paid to consumers,
03:07but also a retroactive refund of the franchise tax paid to consumers since 2011.
03:15It's almost 3 billion pesos,
03:17the franchise tax to ordinary consumers.
03:24But it looks like the PRC is not amenable
03:26because they said that their resolution is for 2023 onwards.
03:30We suspended the passing on of charges moving forward,
03:34so from the August 2023.
03:37What is the rule of the city if you can consider that it should be retroactive?

03:45The Energy Regulatory Commission clarified that if there is one,
03:49it will not be a refund,
03:51but a rebate to the electricity bill of the consumer
