00:00Jay-Z is staying on the offensive going after not only the attorney who filed the rape lawsuit against him, against him and Diddy, that would be Tony Busby, the attorney, but also the accuser, and he has filed a new motion this morning, which we're going to get to in a moment, but basically he wants to level the playing field with the accuser.
00:25But first, we've got to start with this response that Jay-Z had to the allegation.
00:30Catch you up real quick if you hadn't heard, but a woman who had filed a lawsuit against Diddy back in October, alleging that he had raped her at a VMA afterparty in the year 2000 when she was only 13 years old.
00:44Right, remember this is when Charles, she allegedly was given a drink, she felt woozy, and there was Diddy and there was a male celebrity who was unnamed at the time and also a female celebrity.
00:53The unnamed celebrity is now named.
00:56She refiled the lawsuit on Sunday.
00:58She and her attorney, Tony Busby, refiled it and named Jay-Z as the unnamed celebrity involved in the rape.
01:06Jay-Z's response is extraordinary in that, look, we've seen all these lawsuits against Diddy, dozens of them now at this point, and frequently his response has been to deny it but to say nothing else.
01:19Jay-Z went way more than just denying it.
01:22He did do that but then went directly after the attorney.
01:26Part of his statement said,
01:50Marines are known for their valor.
01:52You have neither honor nor dignity.
01:55There were other shots at Tony Busby in his statement where he called him an ambulance chaser in a cheap suit.
02:02Yeah, I mean, the reality is, and if you've heard Tony Busby's name before, it's because he seems to always find his way, I'm not saying a bad thing, but he seems to always find his way into the big case, Charles, right?
02:12I mean, if it's Travis Scott, if it's Deshaun Watson, the NFL quarterback, he's always involved.
02:16So Jay-Z had that strong response.
02:19Tony Busby isn't backing down and in fact said that he denied that there was any extortion.
02:26He said, my client merely reached out and wanted to have a confidential mediation.
02:33Now, I got to say, I don't know what that confidential mediation would be about other than money, but his point is the letter itself did not make any request for money.
02:42Right, though I'm sure that was coming.
02:44Yeah, it sounds like Busby's response was a little bit disingenuous.
02:47The confidential mediation would be where they would broker a settlement and not have the issue go public in the way that he did.
02:53He also mentioned that Jay-Z has sued him and that got us thinking there was an anonymous lawsuit filed against Busby alleging extortion.
03:03Back in November, yeah.
03:04That's right.
03:05Now, Jay-Z, in his recent motion that you referenced earlier, has said, yeah, that was me.
03:09Because when you sent your demand letters to me, I then went forward, stood my ground with an extortion lawsuit against you.
03:15And now if you're going to continue this whole spectacle, I want the accuser's name out there as well.
03:20She shouldn't be able to sue me as a Jane Doe.
03:22He says, fair is fair.
03:23This is a retaliation for me standing my ground when you tried to extort me.
03:28And now let's just get it all out there.
03:30Right.
03:31So follow the beats here.
03:34First, Diddy is sued.
03:35Right.
03:36The unnamed celebrity.
03:37And at the time when we covered that, we thought the fact that they didn't name this person sounded like they were probably reaching out to that person to try and get a settlement.
03:48Jay-Z says that is exactly what happened.
03:50And when he turned him down, he thinks that the only reason they have now refiled this and put his name in there is retaliation for Jay-Z suing Tony Busby for extortion.
04:02So this is going around and around.
04:04But a very strong denial from Jay-Z.
04:07It is.
04:08And look, we've seen not just in this Diddy situation.
04:10We've seen a lot of cases in the past where celebrities have been accused of wrongdoing.
04:14This hardly ever happens, Charles, where you see the person under fire, the celebrity fire back and this intensely.
04:22Right.
04:23Back at the attorney and then filing Derek this motion for the accuser.
04:26Right.
04:27He is not taking this lying down, clearly.
04:29And look, you're allowed to file documents anonymously, particularly where there is allegations that she was only 13 when this happened.
04:35So that's not uncommon to see.
04:37But Jay-Z now thinks this is an extortionate plot.
04:40And he says in order to unearth all of this and unmask it all, we now need to know the identity of that person.
04:45And since it happened in 2000, she's obviously of age now.
04:48She's alleging that she was 13 in the year 2000.
04:51And he's saying we need to put all our cards on the table.
04:53I need to be able to identify my accuser and actually fight this lawsuit on its terms on its face.
04:58Yeah.
04:59I think it would be extraordinary, I think, Derek, if the judge did force the accuser to because and this is the really alarming part of this case.
05:09We're talking about a 13-year-old is the alleged victim, a woman who was at the time 13.
05:15And by the way, Tony Busby isn't backing down.
05:18He said that his client remains steadfast in her resolve in this case, that she will not back down and that she is going to continue to seek justice.
05:28So it's going to be interesting to see what the judge says here because we did see the judge demand that in one of the cases the accuser be revealed.
05:40It was actually Evander Cain, the NHL star's ex.
05:42I understand it, Charles, from the standpoint.
05:44It's like how do you defend yourself?
05:46And this is not a criminal case.
05:47It's fine.
05:48But how do you defend yourself in a court if you don't know who is making the allegation against you?
05:52That's the argument that Jay-Z is making.
05:54Marta Shea from Montreal.
05:57I mean, guys, who is really surprised by this?
05:59Right.
06:00I'm not.
06:01I don't believe anyone else is.
06:02Jay-Z and Diddy go way, way back, decades.
06:05Right.
06:06They've been friends since, what, 1990.
06:08That's about 30 years of solid friendship.
06:10It was only a matter of time before Jay-Z was also accused of such crime.
06:15Now, whether it's a plot or not, whether it's true or not, we can all agree that this is the fastest we've seen Jay-Z respond to allegations or accusations.
06:25He did not take this lightly.
06:27Yeah, and it's very clear he also saw it coming.
06:29Yeah.
06:30Right?
06:31Because he knew that he got that demand letter.
06:33He had sued Tony Busby.
06:36This was not something that suddenly pops up on Jay-Z's radar.
06:40Right.
06:41He wasn't caught red-handed.
06:42They were ready.
06:43Yeah.
06:45Right.
06:46Right.
