00:00This unknown man was doing First Amendment auditing while open carrying a gun.
00:04It starts out with this Sigouan, Texas Police Department lady cop trying to bait this unknown man into jaywalking, but he doesn't fall for it.
00:13Move!
00:17Come over here quick.
00:18How do you come over here?
00:20I don't want to cross the street.
00:21Huh?
00:22I don't want to cross the street.
00:23I can't hear you.
00:24I don't want to cross the street.
00:26Well, why not? You've crossed several streets.
00:28I know.
00:29I just don't want to cross the street right now.
00:31Okay, do you have an ID on you?
00:32Um, I don't.
00:35Okay, I need some form of ID that you have.
00:38Do I have to give you ID?
00:39Yes, sir, you do.
00:41Pause!
00:42Texas Penal Code 38.02 Subsection A only requires a citizen to provide name, date of birth, and address when the citizen is already lawfully under arrest.
00:56In other words, this lady is full of shit.
00:59And even worse, she knows that she will take back her own words in a few seconds.
01:05Just watch.
01:06Just for identification purposes.
01:08I don't have any problem giving you ID.
01:10Okay.
01:11But as long as there's a lawful reason for doing that.
01:14Yes, because I'm conducting an investigation and I would like to just get your ID just for identification purposes.
01:21Okay.
01:22I'm going to decline to give it.
01:24Are you suspecting me of a crime?
01:25Am I committing a crime right now?
01:27No, sir, but if you could understand where I'm coming from, you're out here with a shotgun, you got your shells and all that good stuff, you're videotaping me, which is perfectly fine.
01:34I'm used to that.
01:35And so just for identification purposes and for my report.
01:43So I just have one question for you.
01:46If I don't give ID, then how do you handle that?
01:51Well, there's other ways to handle it, but we don't really need to do all that.
01:55I mean, if you could just give me your ID and we can talk about why you're out here with your gun and what all's going on and why you're videotaping, that would be great.
02:01Okay.
02:03Am I being detained right now?
02:04Yes.
02:05Okay.
02:05What am I being detained for?
02:07For while I'm completing my investigation as to why you're out here with your shotgun or.
02:14You're aware that it's legal to open carry a rifle or shotgun out in public, right?
02:19Is there an ordinance against it?
02:21No, but when we get a call like this.
02:23Usually everybody cooperates with.
02:25Nobody gives us a hard time.
02:26I don't mind cooperating.
02:28Okay, then you can cooperate fine.
02:29But what I do mind is.
02:31Is it just for the purpose of YouTube?
02:33Like, is that all?
02:35Let me finish.
02:36I don't mind cooperating at all.
02:38I don't mind giving ID.
02:39I'm not trying to hide who I am.
02:41But I do have a problem here is that given.
02:46Look.
02:47You can talk to me.
02:49She's there because you're not asking me for ID.
02:51She is.
02:52Okay, you're good.
02:54So anyway, what I do have a problem is.
02:56Is give an ID to an officer who tells me I have to when I don't.
03:01I didn't say that's why I asked you for it.
03:03Bullshit replay the clip.
03:05I need some form of ID with you that you have.
03:08Do I have to give you ID?
03:09Yes, you do.
03:10I didn't say that's why I asked you for it.
03:12Okay, so I don't want to give it.
03:14Okay, and why wouldn't you want to give it to us?
03:17And then on top of that, I'm being detained.
03:19And still, there's like no.
03:20Let me ask you this.
03:21What it what purpose are you trying to do out here?
03:24I mean, what's exercising my right to open carry?
03:26Okay, and that's okay.
03:27But do you understand that we've gotten several calls on you?
03:30And we're just wanting to know why you're out here.
03:32I mean, it's you're you're right.
03:34It's completely fine that you're out here.
03:36But you know, in order for this to be okay.
03:39Not that to be okay.
03:40That's not the right terminology.
03:42You know, you're out here videotaping and all that.
03:44Got that right too.
03:45But just to cooperate with issues like this that.
03:49Cause things to happen to go wrong.
03:51When all I did was simply ask you for your ID.
03:53I'm doing my job.
03:54I'm coming out here and asking the public.
03:57The public asked me to come see what was going on.
03:59So that's what I'm doing.
04:00And I don't understand what the problem is.
04:03The problem is you showed up.
04:05So leaving solves that.
04:06You already lied once.
04:07And now you're contradicting yourself.
04:09Watch how she characterizes these actions in a good light.
04:13Four different times.
04:15If you could understand where I'm coming from.
04:17You're out here with a shotgun.
04:18You got your shells and all that good stuff.
04:19You're videotaping me, which is perfectly fine.
04:21I'm used to that.
04:22You're aware that it's legal to open carry a rifle or shotgun out in public, right?
04:28Is there an ordinance against it?
04:29No.
04:30What purpose are you trying to do out here?
04:32I mean, just exercising my right to open carry.
04:35Okay.
04:35And that's okay.
04:36It's completely fine that you're out here.
04:37However, when her tactics don't work anymore.
04:40She changes how she characterizes his actions to suggest he was causing issues.
04:46You know, in order for this to be okay.
04:49Not that to be okay.
04:50That's not the right terminology.
04:52You know, you're out here videotaping and all that.
04:54Got that right too.
04:55But just to cooperate with issues like this that cause things to happen to go wrong.
05:01But I also, for my report, I need to get your ID because we have to,
05:05I have to, because the sergeant's going to ask me, why did you get him identified?
05:09Well, then tell your sergeant that the law dictates how you do your job.
05:13And Texas Penal Code 38.02 subsection A is not implicated in this incident
05:19because the person is not lawfully under arrest.
05:22Therefore you can't use it.
05:24Also side note, the law only allows an officer to demand three specific information,
05:30which is name, residence address, or date of birth, which she never requested.
05:37She demanded physical ID, which the law does not require one to carry or produce upon demand.
05:44Because we do that for all our reports.
05:46And I don't understand what the big deal is with you.
05:48I mean, unless you've got a record or something,
05:50unless you've got warrant or something, and that would be the reason.
05:52I know, right?
05:53Like not when the ID goes up to red flag, right?
05:55You have to understand, look, if it's, if you're causing alarm by the public,
06:02we can drive by, we know there's open carry, we're fine with that.
06:05But when it causes alarm and somebody said that you had your finger on the trigger,
06:09which calls for concern, we don't know if that's true or not.
06:13It's just, we go off of what the caller says.
06:15Which, which we know nobody called in and said that.
06:18We know what they called in and said.
06:20Yo, that face shows he's lying.
06:23He didn't call in.
06:24At least we know what your dispatcher said.
06:26So what did she say?
06:27Let's get onto the nitty gritty.
06:29So let's get onto the nitty gritty.
06:31No, that is what she said.
06:32Okay.
06:32Then what's, if you want to read my call notes, you can.
06:36That's what they say.
06:37That would be great.
06:38That says so far, you haven't told me what if I'm committing a crime or that you suspect me.
06:42You're not committing a crime.
06:43We didn't say you were committing a crime.
06:44And you don't suspect me of committing a crime.
06:46So if you know what they called, were you all the ones that called?
06:49Having a finger on the trigger or having it in a ready position, that would be against the law.
06:53Which is what they said.
06:54But what I'm asking is if you say.
06:56Which is what I just asked you initially, right?
06:58But if you said that that's not what the call came out as,
07:01were you all the ones that called?
07:02No, absolutely not.
07:03Well, how would you know?
07:04And I'm not going to answer that question.
07:06I have a feeling that y'all were fishing for this.
07:08But.
07:09And y'all called in.
07:11So y'all are abusing 9-1-1.
07:12I'm just exercising my right to carry.
07:14Let's just leave him alone.
07:15They're setting us up.
07:16They went to the PD and they recorded it in the PD.
07:18So let's just leave.
07:19Let's just leave.
07:19Hey, can I get some, can I just get some name and badge numbers before you guys go?
07:22I don't think you can do that either.
07:23No?
07:23Let's go.
07:24Okay.
07:25Nobody wants to give me a name and badge numbers.
07:28Thank you guys for being assholes.
07:31Learn the law.
07:323802.
07:33Federally identified.
07:34Learn it.
07:35Especially you, lady.
07:36That's where this incident ends.
07:38What do you guys think about the lady cop's tactics?
08:01You.
